Hello VJ users, I'm new on here and very confused as to what I need to do

I am a US citizen, engaged to Brazilian on a F1 Visa

We are planning to get married before the year ends and we're confused as to what forms, paperwork is necessary to be filled out ?

We want to get married in the States and fly to Brazil for a small reception

Anyone with the similar experience, or any help is appreciated :)

Once married, I-130, I-485 and I-765.

You may have a few months wait befor that reception in Brazil

Plus I-131, if wanted.

You could go to Brazil first for the reception, and then file for Adjustment of Status after you come back to the US. Once you file though, it is recommended not to leave the US.

This won't work. The foreigner here on a student visa cannot adjust status if they had immigrant intent on their last US entry. It's ok to enter, decide to marry, marry and adjust status in that order. But not to decide, leave, return, marry and adjust status. Student visas are not dual intent.

Perhaps you meant here now, decide, marry, leave, enter and adjust status. That won't work either.

I got the impression from the OP that his fiancee did not have the intention to get married upon her last entry. She came here to study, met the OP and they are currently considering marriage. So far, so good. On second thought, you're right, if they do decide to marry, then she cannot leave the US until she gets the greencard, or Advance Parole (which does not guarantee re-entry). Technically, the only way to go to that reception in Brazil is to apply after marriage for AOS (concurrently with I-130), including Advance Parole, and then travel to Brazil on the Advance Parole, while being aware of the potential risk of not being admitted back in.

I still suggest reading the student visa thread and getting advice from fellow VJ members who are going through AOS from a student visa.

The way i read it was....marry in USA - they could travel if they then filed asap and included AP - as soon as they get AP they could use this to go to Brazil to have a reception?

That will work but itineraries that will not work were proposed including the one offered by the OP originally.
