I filed an I-130 for my husband at the Amsterdam consulate in November 2006. In January 2007 I requested it be transferred to Germany, where we were moving, but never when through with contacting the Frankfurt consulate to transfer it.

I have a case number, but I'm not sure how to find out if the I-130 is still 'pending.' I want to cancel it, but I'm not sure how to go about this. Any advice?

TIA

Visit USCIS Registration, create an acct and then ADD your EAC# to the porfolio. That should let you know what's going on.

Thank you so much for directing me to this site.

When I added my case number, it told me 'case does not exist'. Can I assume this means my case has lapsed and is now void?

I wouldn't assume that. Perhaps you made a mistake in entering the case number. Did you start with three letters? Either way, call USCIS and ask them.

Might be a good idea anyway to send a notarized letter to where you originally filed your petition stating you want to cancel. They will send a notice verifying such.

I did start with the 3 letters, and I double checked the case number. But you are very right, better not to assume anything.

I will go ahead with the notarized letter and send it to the Amsterdam Consulate. Any tips on what wording is best used? Is there any need to explain why I want the I-130 canceled?

Thank you for all your help.

What you want is to "withdraw" the petition. You need no explanation and I would generally advise against giving one. A simple, "I hereby withdraw the I-130 petition filed in behalf of my spouse, First Middle Last." followed by your signature and preceded by referencing the case number will be sufficient.

It seems that this person is a DCF petitioner. The website indicated above won't help them. I would contact the consulate where you initially filed to find the status if that is what you want. Were you intending to cancel it and not refile ever or were you planning on refiling at the consulate where you live now?
