Hi,

My husband and i are getting started with our paperworks for the AOS and

i would just like to ask wether the Notice of Action he received (while we

were still processing the K1 visa) is needed. Is it necessary to enclose

the NOA (Approval) to our AOS package?

Thank you so much. We're kind of concern coz he lost it.

Please enlighten us. Thank you and more power.

You do need the copy of the NOA-2 approval letter for K-1 and K-3.....

Start looking for the approval notification - you do need it.

Instructions from the AOS application:

15. Evidence of Eligibility:

B. Based on admission as a K-1 fiance(s) of a US citizen and subsequent marriage to that citizen: Attach a copy of the fiance(e) approval notice, a copy of your marriage certificate, and your Form I-94.

YES you need to send the NOA2(approval) from your k1 visa as 1 of the requirements in AOS. Here's the guidelines...

April 13, 2010 - received NOA1 (dated 04/08/10)

May 07, 2010 - Biometrics

May 10, 2010 - Touched

June 23, 2010 - APPROVED WITHOUT INTERVIEW!!!

Yes, you definitely do need it.

Naturalization

Son's N-400 Timeline

08/14/2020 - Sent N-400 and I-912 waiver to TX lockbox

09/18/2020 - NOA via text

06/05/2021 - Notification of biometrics scheduled

09/17/2021 - Interview - decision cannot be made

11/24/2021 - Denial letter, 30 days to appeal

12/24/2021 - Appeal sent back with I-912 waiver

12/24/2021 - Motion to terminate deportation proceedings from 2013 filed

If you have indeed lost the approval notice, then you'll need to apply for a new one and hold off the AoS application until it arrives. You can apply for a copy by filing I-824 - Application for Action on an Approved Application or Petition.

The fee is $340.

Thank you to all who responded. We'll exert all effort to locate the approval to veer away

from paying that amount. This is making me even more tense!!!

Timeline

I never even received the NOA2 but the USCIS web site shows that it was sent. I have been so worried about it that I went to a lawyer and he said that the printed page from the USCIS showing the approval date and the mailing date would be fine. I must have asked him 100 times if he was sure I didn't need the mailed copy and he assured me that the one he printed for me would be fine. If this is the case then what is the need for the I824?

Any opinions?
