Hi,

Does anyone know what documents are needed to apply for a drivers licence?

I arrived here on a K-1, am now married and have applied for AOS and have my NOA1.

I actually have an American licence already from when I was here on a different visa (J-1), but it has expired. I know I dont need to take another test since it is less than a year since it expired, I just need to re-new it.

Have any of you got a drivers licence with just these documents?

Thanks

:)

My husband just got his driver's license here in AZ. He needed his passport, proof of residency with something with his name on it and my address. I think also his Social Security card. I know he only had to take the written test, which is now computerized.

Good Luck,

Moondancer

Hi Clara, I think that it depends on the states regulations.

Here in California, you need to wait til EAD card comes after the expiration of K1 visa status while applying for AOS. Because pending I485 is not allowed for the DL. I think law has changed last summer. I am not sure about CO...

I don't think it mentions anywhere about an EAD as being acceptable?

Does anyone know what this translates into English as....and does it mean AOS'ers can get a license?

A. Proof of Age/Lawful Presence

5. Valid foreign passport with I-94 or valid Processed For I551 stamp; NO B1, B2, WT, WB, CP or NC status. (Status F, J, H, etc., requires verification of a Colorado connection through the sponsoring entity and original letter, by the Colorado employer, of Colorado employment or verification of education through the valid DS-2019 or I-20AB.)

I looked on the link and from the way it is written it sounds like in Colorado you dont need an EAD, and that it is possible to get a DL. I'm going to try either mon or tues. I'll keep you posted on what happens.

Thanks

The states are changing their laws to comply with the Federal REAL-ID act. One requirement is that you have to prove that you are in the country legally and they will want to know your status. So if you show them the I94 that you entered as a K1, and it still has 45 days left on it, they will only issued you a license valid for 45 days. If you show them an EAD that is valid for a year, they will issue you a license that is valid for a year. You will also need a SSN. This is the way that its working now in Nevada, and I think that all states are moving in this direction. Some lag behind others, but they still have a few years to comply with all the provisions of the REAL-ID Act.

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.
