I got married with her in Ecuador after the consul interviewed her is this going to be a problem for her AOS??? What is the next step to make her a permanent resident...

Yes, you could now have a serious problem with her AOS. She was supposed to ENTER the US as your FIANCÉE (not as your wife) and THEN marry you.

At the risk of being rude, WHY (after going to all of the trouble with the K1 process), did you get married in Ecuador???? And NOT the USA?

'cause they're was some issues from her side she was thinking she was going to get denied. They didn't issue her a visa or an approval we had to send in some more documents in for the consul. So me and her getting ahead of ourselves decided to get married just in case they did deny her, then we would apply for the k3 visa...any suggestions as to this problem....

If what you wrote is true, it appears your next step is an I-130 petition for an immigrant visa and you begin the wait all over again.

Now, you will need to file the I-130. You are dangerously close to visa fraud and a ban. PLEASE follow the proper steps now and onward.

I believe she was referring to any attempt of entry on the K-1 since your SPOUSE is no longer eligible to use that visa.

Unfortunately, I think the previous posts are correct. You may well have to start over.

Your wife is now in the USA on a K1 Visa. As far as the US authorities are concerned, you are not married - and this is the basis on which she entered the US. The two of you are supposed to conduct a legally valid marriage in the USA within 90 days from her date of entry and the file for your AOS. However, as you are now MARRIED, this may not be possible.

The next problem is her status. Technically, she was not legally capable of entering the US on a K1 once you married in Ecuador, so that definitely raises the question of the legitimacy of her current status in the US. Okay, she's your wife, but you applied for your fiancée to come to the US. This raises a serious issue with visa fraud - intentional or otherwise. As to bans, in a wost case scenario, it is possible that your wife could indeed find herself forcibly removed from the US as a result of the situation you've described.

For the record, nobody's trying to be cruel here, or kick you when you're down. I'm sure what you're reading is completely WRECKING your head, but it doesn't detract from the fact that your wife and maybe even yourself could now be in very serious trouble.

You need to talk to an attorney, mate. And I would do so very, very, quickly, if I were you.

According to the OP, they got married in Ecuador after the consulate/embassy interview, but she entered the US on a K1.
