firstly please do not judge me on who i married, we all find love in different places, sorry to be blunt but i need help n dont want to be judged at the same time,

ok here goes,

back in 2003 i married a prisoner in the usa, im from the UK, i did call our Embassy here asked advice i was told that as i wasnt planning on staying in the usa i didnt need a visa of any kind,

now 6 years later reading on another forum, i find out i did need a visa a K1? i think,

ive been back n forth many times with no problems,

but what do i do now? people say that i cud get in a lot of trouble with homeland security,

i didnt know i had to have this other visa, i would of thought the court house where i got my marriage licence from would of asked to see it?

im scared they will put me in prison, can they do that? can they anul our marriage?

please does anyone have any advice??

Do you still live in the UK? Your married to a US citizen? Are you wanting to live in the US now?

You only needed a K-1 if you intended to settle in the US.

Actually if they are already married and wanting to move to the US wouldn't it be the K3 they need?

She's not asking about coming back, she's asking if she needed a K-1 when she came here to get married. And the answer to that is no.

OR CR-1.

As long as there ha not been any overstays since marriage, then there should be no problems for US citizen to file for CR-1 or K-3.

Use timelines, filter for UK and sort by interview date, and look at the total time column.

CR-1 has less paperwork to file over all, cost less, and results in a green-card upon entry to the USA.

Do you want to be able to take a JOB soon after arriving in the USA? K-3 is NOT work auth and cannot work until getting Green-card or EAD. EAD can take 90 days or more to get, all that time the K-3 holder cannot Work, get SSN or even apply for a driver's license. All these things can be done by a CR-1 visa holder because they get green-card at the time they arrive in the USA.

Hello,

K-1 visa is a fiance visa, it's for one person living outside USA who want to marry a usc fiance, they fill out forms and the foreign fiance receive a K-1 to marry the usc fiance in America.

You can't apply for that.

The K-3 visa is for a married couple and the usc wants his SO comes in USA so, they fill out some forms and the foreign SO can live in USA with his american SO.

You don't enter in those category, you can use your passport (it seems me that the UK benefits from the visa waiver program) to go in USA. The only problem can be at the POE, they are a little suspicious on the ports of entries.
