K4 process once in US

Hi all...I've been looking on VJ for answers but not finding much when it comes to the kids...

I just want to be prepared for when we arrive in the US...I plan to file my AOS & EAD as soon as I get there...as my son will be K4, what do I file for him? same thing? do I have to file an I-130 for him first? thank you in advance!

Hi there

All you have to do for your son is to send in thew same application that you are sending in for yourself so one set of paperwork for you and one for him you can put it all in the same envelope (I did for my son and it took us all of 5 months from date we sent it in to date of greecard in hand and we had a rfe) all i did was copy everything I used for evidence on my claim and attatched it to my sons (birth certificates, marriage certificate etc).

Yes, the procedure is the same for K4 as K3. If no approved I-130, you'll need to file that too. I'd file it all together. You'll need three separate checks.

Yes, the procedure is the same for K4 as K3. If no approved I-130, you'll need to file that too. I'd file it all together. You'll need three separate checks.

I-130 is filed first or concurrently. No need to wait for the NOA1. Like I said, file them all together with three separate checks. Treat each petition or application as a separate submission but put them all in the same envelope.

Not having file the I-130 for the child long ago will delay the AOS process and possibly result in two separate interviews.
