IR-1 vs. CR-1

I really cannot figure this one out and I need explanation.

Yesterday my hubby and I got I-130 approved, and we applied through DCF. We were married in October 2006 which I guess qualified me for CR1.

In case everything goes well and we get the visa issued (considering that I will have 6 months to enter USA), we planned to go to USA in November 2008 which will be over 2 years of marriage.

What happens with I-751? Do we still have to file it even if I never entered USA before those 2 years expired?

And just a little additional question. Is it possible that through DCF only IR-1 is issued and that conditional residence actually depends on the lenght of marriage on the date of admission???

I think information got mixed up in my head again...

The determining factor for whether the green card will have conditions is the length of marriage at the time you enter the USA. There have been cases where mistakes were made in card issuing but they are correctable.

A November arrival will result in an unconditional card even though the visa itself is CR1.

Facts are cheap...knowing how to use them is precious...

I enquired about this exact thing myself as I won't be entered the US until after our 2 year anniversary, but I'll probably get the CR-1 before that. The consulate said I would get a 10 year green card if I went thru the POE after our 2 year anniversary and I wouldn't have to remove conditions.

07.23.2018 Sent I-751 Priority Express to CSC (California)

08.02.2018 18 month Green Card extension letter

07.16.2019 Biometrics complete

09.04.2019 Case transferred to Lee's Summit, MO (NBC)

03.22.2021 New card in production

03.23.2021 I-751 approval notice (without interview)

03.27.2021 10-year green card received

 

N400 Naturalization Application

07.22.2019 Online application; USCIS estimated completion Sept 2020

07.31.2019 Biometrics complete

12.18.2020 Contacted State Senator (I-751 pending for more than 2 years)

05.10.2021 Interview  - recommended for approval

06.03.2021 Oath day...finally done!!
