Dear All,

The instruction for I-485 submission says:

“Attach a copy of the fiancee petition approval, a copy of your marriage certificate and your Form I-94.

1. Does it mean that it is Ok to submit a PHOTOCOPY of marriage certificate ( and not certified copy issued in Clerks Recorder Office)?

2. Does it mean that the original I-94 should be submitted in case of K-1 visa holders (not a copy)?

The marriage certificate needs to be an original, but the fiance petition approval and I-94 can be copies. You can take the originals to your AOS interview when the time comes.

Marriage certificates can be obtained very cheaply, so get at least a couple of copies so you have them for future use.

Many people submit copies of everything but I agree with Ray - send them your original marriage certificate - they are only a couple dollars a piece anyway. I did the same. Good Luck

Hmm, I submitted a copy of the certified marriage license. The application clearly states that when it says a copy is needed, that means a copy, not the original - and that it would say if the original was needed. And it says to send a copy of the license, not an original. If I get an RFE for that, I'm raising hell!

(I did get an extra copy of our marriage license just in case. I guess you'll be safer that way.)

Either a copy of the certified copy or the original certified copy are fine.

For I-94, definitely don't send the original, you'll need it for the interview or when you leave the country.

09-02-2005 Applications for AOS, EAD, and AP received by MSC

10-21-2005 AOS fingerprint notice for 12-08-2005

11-07-2005 AP approved

12-05-2005 Infopass appt at San Jose office for interim EAD -- Refused, because it is already approved by MSC on 11-07-2005

12-07-2005 Attempt at interim EAD at San Francisco office -- no go. Back to San Jose, where CSO (chief station officer) tells they will contact MSC via email to request permission to issue interim EAD

12-08-2005 Biometrics for AOS and EAD. Having no EAD appt letter was no problem (used EAD NOA)

12-15-2005 EAD arrived in the mail

12-24-2005 Received interview letter; interview scheduled 03-01-2006

01-28-2006 Received replacement SSN card in married name (5 wks since application)

03-01-2006 AOS interview -- approved; received stamp in the passport

03-13-2006 Green card arrived in the mail
