Adjusting Status after getting married on a workers visa

Timeline

Hello...im adjusting from H1B currently....I dont see why you would have to wait to get married (or file for AOS)..the H1B is a dual-intent visa so you can enter the US with it and have intentions to immigrate...why did they tell you to wait?

Anyway....once you file for AOS (after you get married), your SO can keep her H1B status while the AOS is being processed as long as she continues to work for her H1B employer....if she then chooses to change employers she will need to apply for an AOS-based EAD, which would then terminate her H1B status....at that point she will not be able to leave and re-enter the US unless she has an Advanced Parole approved on her behalf....

Filing for AOS from H1B is just like filing from K-1 status...its the same paperwork, same fees, same timeline (sort of)...so the guides here can help you...

Timeline:

12/15/2007: Wedding

02/11/2008: AOS/EAD/AP/I-130 package sent

02/12/2008: Package received by USCIS

03/21/2008: Received package back (38 days), rejected due to missing signature on I-130 (darn it!!)

03/21/2008: Sent the package back to USCIS

03/23/2008: Package received and signed for by J Morones

03/27/2008: NOA dates

03/28/2008: Checks cleared!

03/29/2008: Received all 4 NOAs in the mail

03/31/2008: All 4 cases are online

04/02/2008: Biometrics letter (appointment for April 15th, 9am)

04/12/2008: Biometrics completed

06/12/2008: AP and EAD approved!

01/30/2009: Green card approved

02/26/2014: N-400 received by USCIS

03/20/2014: Biometrics appointment

06/10/2014: Initial Interview scheduled (request for re-schedule submitted due to pre-planned international travel)

06/13/2014: New interview letter issued for: 07/21/2014

07/21/2014: Interview completed: recommended for approval

07/24/2014: Received e-mail notification, case status: oath ceremony

07/28/2014: Received notice in the mail scheduling Oath Ceremony for 08/05

Which visa category specifically?

Not sure as to what the visa specifically will be though it will be some sort of workers visa which would allow her to work at InterVarsity for the graphic design internship.

All answers would be unreliable without this information.

Well yes I understand that but I don't know what are all the different work visas available though since most people tend to say a H1B visa is in hand then let's see about that one.

Then I suggest you google "H1B visa dual intent" for your hypothetical question.

Did you do it?

Until you know her actual visa category this is all a hypothetical exercise. If she comes on an H1B visa the information you'll see by googling as suggested will provide you with most of your answers straight from reliable sources.

Sometimes the best way to help somebody is to help them help themselves. You know the give a fish or teach to fish scenario.
