USCIS to Revise Filing Instructions for Petition to Remove Conditions on Residence

Form I-751 to be filed with the California or Vermont Service Centers

WASHINGTON—U.S. Citizenship and Immigration Services (USCIS) will soon be revising the filing instructions for the Petition to Remove Conditions on Residence (Form I-751) to require filing at the California or Vermont Service Centers, where all Forms I-751 are currently adjudicated. The adjudication functions for these petitions have already been assigned to these locations in anticipation of this change. Therefore, all petitioners filing a Form I-751 are requested to file the petition with the California or Vermont Service Centers, depending on the state in which they reside.

Form I-751 is used by individuals who were granted conditional residential status through marriage to a U.S. citizen or a lawful permanent resident and who desire to petition USCIS to remove the conditions on their residence.

Petitioners who live in the following states or territories should file their Form I-751 with the California Service Center (CSC): Alaska, American Samoa, Arizona, California, Colorado, Guam, Hawaii, Idaho, Illinois, Indiana, Iowa, Kansas, Michigan, Minnesota, Missouri, Montana, Nebraska, Nevada, North Dakota, Ohio, Oregon, South Dakota, Utah, Washington, Wisconsin, and Wyoming. However, there could be a slight delay in the adjudication of the petition as a result of the transfer; so, petitioners are encouraged to file directly with the appropriate service center as outlined above. If a petitioner receives a receipt notice from the Nebraska or Texas Service Center, his or her case will be transferred to the California or Vermont Service Center for adjudication. The petitioner should receive a notice advising him or her that the case has been transferred.

Oh Mannnn, that's why when I checked the status of the package I sent a few days ago on the USPS website they said it has been forwarded to a different address!!!!How was I supposed to know, I checked the address on the application (on the USCIS website)and it was Lincoln, NE and now it's CA!!!GREAT more and more delays...

Actually, being sent to California is not going to be a delay - it will actually result in your application being approved much faster than if it had stayed in Nebraska (who is no longer processing these applications but was notoriously slow when they were) and definitely much, much, faster than if you had had to send it to Texas or Vermont. California is approving these applications in approximately 5 months. Vermont is approving them in 15 months. Believe me, I know about USCIS delays - My husband and I started this whole process in June 2003. We have filed all of our part of the process in a timely way but it all adds up: 1 year for a K-1 and marriage; nearly 2 years for AOS (yeah, just a few weeks short of our 2nd anniversary!) and now our I751 has been in Texas/Vermont going on 5 months, and I am seeing applicants who submitted around the same time as me already getting their approvals from California. I would LOVE to be in your situation. Realistically, I am probably looking at another year before I get my approval from Vermont who are only now approving applications submitted last Winter and Spring.

Well I mailed my I-751 application to the Texas Service Centre on the 23rd May, the day USCIS released their update and it was signed for on the 27th, my check was cashed on the 30th and on the back of the check it looked like there was a receipt number written on the back as it starts with SRC which is for Texas, so it looks like I will be transferred to Vermont which is even slower than Texas if I understand correctly

yes Magpie, that seems to be the process for Texas - they cash the cheques and then they forward the whole package onto Vermont. Since Texas isn't doing I-751s any more Vermont is the slowest - and California is the fastest.
