I was once denied entry into Detroit about 5 years ago coming in from London on the visa weiver scheme as I didn't have enough 'ties' to my home country and the officer thought I may be coming here to work illegally as I had worked in the states on a H2B visa before this incident.

Since then I have been giving two H2B visas and been let into America to work both times without an hassles. I have never over stayed or any criminal records etc. Now my fiancee and I are wishing to get married and live in the USA but I'm worried this may affect me...has anyone got any advice on this or am I just worry a little more than I should be??

I don't think this is cause for concern. If all is in order in your application there shouldn't be a problem.

Being denied entry is a bit traumatic, so I fully understand why you would feel that way.

Thanks, yes was very traumatic as they are so intimadating when you hand over your passport to them and I just thought I would have a 'black flag' next to my name everytime I go in now.

It shouldn't be a problem. It happens to Canadians quite often. Not having enough ties, and being told you're denied entry IS devastating, but not uncommon. Just make sure you tell them about it at the interivew if asked. They didn't make any notations on your passport I'm thinking?

Hi Dave, welcome to VJ.

Your denial at POE wont effect your K1 visa.

My SO ( also from NZ ) was denied entry back in September. He had been in and out of the country MANY times in about a year and a half and was basically living here on the VWP. I was awaiting my divorce and we simply wanted to be together. We were very 'lucky' to get as much time together as we did as he had moved house and quit his job by this point! ;)

Anyway, it wont be a problem as long as you have no illegal entry or overstay. :)

Just wanted to add more reassurance that being denied entry for lack of ties to your home country does not affect the K1 visa process. :)

24 Feb 2007 - Sent I-130 to London USCIS office (I'm the petitioner)

25 May 2007 - NOA2

2 June 2007 - Received Packet 3

12 Oct 2007 - Sent Packet 3 back by special delivery

5 Nov 2007 - Interview in London - Approved without any hitches!

7 Nov 2007 - Visa and MBE arrived by SMS! :)

30 Jan 2008 - Fly to Michigan!! :)

*Note: Any delays in our case are only due to us taking things slowly

You should be fine. As was said, just mention it on paperwork and at interview(s) and make sure you file all the proper paperwork now and you should be fine.

It won't be a problem. The reason for the denial - lack of proof of ties to home - no longer exists for the K-1. Just be sure to include it in your paperwork and if asked about it, tell the truth. It isn't a reason for a denial for the K-1 - you will be fine just as long as you are up front with the information about the previous denial. Not telling the truth to immigration is a reason for denial:-). Good luck on your visa journey.
