I spoke to yet another attorney who told me that it would be better if I went to Panama,got married to my fiance,and did a I-130.I was planning just to go and do the waiver,now I'm confused.

I know.But they denied his visa.I already had everything planned to do the waiver also.My congressman also wrote me letter.

I would say go the waiver route first and see what heppens since you have the option of doing that. If that does not work then you can look at other options.

It varies from consulate to consulate I guess, but it took us exactly 8 months till his arrival to US..

Also be aware that he is now in the immigration system even if it is a K1, the reason he was denied the visa will still be a factor in your I 130 process. You might get caught up in that and it could add a bit to your wait time. Right now the I 130 is a big guessing game, some are approved very quick and others are not. Your lawyer is well aware of why the visa was denied and seems confident that he can can make everything go through well enough it would seem so best to follow their advice, your case is one where a lawyer would be best to give you the advice you need.

I'd still go for the waver. A K-3 o r CR1 at Vermont is a ####### shoot at best. They both seem to be ignored at the moment over the K1s and who knows what else.

It was denied because he has a record.From what I hear,the waivers take 8-12 months.I am planning to go down there and file the waiver.I just figured I'd ask another attorney just for the fun of it,and he said I would be better off marrying my fiance instead.
