I-94 and K-1 issue

hello everyone..

I have an interesting problem with my girlfriend because she stayed over on her I-94 time. she overstayed less than 180 days and we have boarding passes within mexico to prove that, but we drove across the border and we never got stopped by any official. The problem is that she still has her I94 card and we are worried about trying to clear this up at the consulte here in guadalajara because i have sent in the 129f about a week ago, and do not really know what she can tell them. she can only prove that she was out before the 180 days, but i figure there will be some kind of punishment for that. she has friends that go back and forth from mexico to US and sometimes they never turn their cards back in and they never have problems. Im really concerned about getting the process rolling up until the interview and then having this delay or deny us, and i was just wondering what might happen with this.. by all appearances to the US she is still there, but she is back here and has been since december. anything, any help someone could give me would be greatly appreciated..

i never found my post after i originally posted it, i think i posted on a friday and came back the next week and could not find it. hence, i figured i would try again early in the week so i could check back before it got buried..is there any way i can find that old post?

Click on My Assistant (upper right part) and a box will come up. From there you can pull up your last 10 posts.

I don't know the answer to your question but your original post was probably lost when the server was down and the site had to be reloaded from a backup copy. A lot of posts were lost at that time. Hopefully you will be able to get the answers you need. Good Luck! :star:

There is a link to search the old forums on the Advanced Search page (linked at the top of every VJ page).

I think your fiance should take her proof of time at home to her interview.

There is an instruction on what to do with an old I-94; it should be returned to the USCIS.
