Hi,

I'm a new member here. I tried to search for my answer but didn't come up with it and thought someone on here could give me some guidance.

My fiance came here on a K-1. We're getting married next Saturday and soon after that will be filing the AoS. So far, she doesn't have a SSN or anything.

When we file the AoS (as well as the I-131 and I-765), do we use her married last name, or continue to use her maiden name? I find lots of resources about changing her name if she already has a SSN, but what about when filing the forms for the first time? I assumed we should use her married name and list her maiden name when asked for "other names used". Is that correct?

Better to get the SSN immediately because if you wait too long (when the I-94 in your passport is less than 15 days till it expires, I believe), they won't give it until after you get the green card or EAD, and that is a wait of about 3 months or more.

After getting married, then have the SSN changed to the married name and file all AOS paperwork in married name.

If your wife wants to use her married name, then she definitely should use that on all the forms (AOS, EAD, AP, etc). That way, her EAD and green card will come in her married name.

If she is not successful in changing her name with the SSA, she should still file all her forms in her married name. She can then change her SSN to her married name by presenting either her EAD or green card.

she should use her married name on the forms.. she can also use the marriage certificate to be able to have it in her married name on the social security card... she can use her passport and I-94 for identity purposes and the marriage certificate for putting the card in her married name

As everyone mentioned,

For AOS : Use the name your wife would like to use from now on in US.

For SSN : Try the same as above, but some SSA would reject. Don't worry, anyway you will have to change the SS card status when your wife gets EAD or GC, and you can change her name on SSC at the same time. SSN is important, but the name on SSC is not that important, since you don't use it as ID.

Me and my fiancee will get married withn 2 weeks of ehr arriving. We were planning to file AOS soon thereafter and to get the SSN for her. She wants to change to use my (USC) last name. What is the easiest process to do this?

Get married -> file AOS -> Get SSN with married name?
