Yeah, I am not to worried about processing time. I live in Calgary, so I believe I would go through Vancouver?

There is an American Consulate in the city, but do they process visas?

I am more concerned at this point about having it accepted, not so much the time it is going to take.

Calgary does not...

If i wanted to I could graduate in January. I do all of my courses online.

We are talking about me doing next semester (because he is coming up here for summer), and then when I have my break between semesters (Jan/Feb 09) we would start the process and hopefully send off the completed I-129 F package/form.

That way if it takes 4 months to go through great, if it takes 6 thats fine too. I would have plenty of time to finish school and go down there withing the 6 months.

Depends on where you live and where the USC lives... If your fiance lives in the region served by CSC then it is nearly 5 months just to clear USCIS. If you live in a region served by the Montreal consulate you can add a significant amount more time (4-6 mos) before you even have your interview. I wasn't kidding with the May 2009 and that means petition submission fairly soon (not after the summer or in Jan/Feb 2009).

Right, there's really no reason to delay. Even if visa is in hand in 9 months you still have six months to use it.

You can file when ready but understand the US Citizen Petitioner is the one who files and also needs to learn the process.

The standard for petition approval is that you are both legally able to marry in the jurisdiction where the marriage is planned. Whether age 18 must be reached before filing is unclear to me, since parental permission can overcome the age 18 requirement in most locations.

no..only vancouver and montreal takes K1 and K3 (and other) ...you know its good if you start your processing as soon as you can...me and my fiance started it 7 and a half years after...like you..we were young when we fall inlove..he was 16,i was 20 ...and it is only now that we have a chance to do it...so,good luck to you...you can do it...paper works are a bit of a headache but its going to be worth it in the end...

Hi and welcome to VJ

I don't really have too much to add that hasn't been mentioned by the other members already. We thought about getting a lawyer to help with the process but decided against it as soon as we found this site. Its so easy if your read and follow the guides - haha easy!

I will say - Be careful trying to plan this process around anything important you have going on at school or in life. We didn't think about it much and all the stress has fallen in my final few months of my degree. If I'd known it was going to stress me out like it has I really would have held off just a little while longer. The difference between a few months could be the difference between me achieving the grades I deserve or not.

Welcome to VJ. Don't forget to check out the Canada Forum here, with specific Canada related immigration issues. I will say that the primary evidence of a bona fide relationship is things you mentioned, your boarding passes, pictures of you together. Proving an on-going relationship is at the interview stage. In the guides it will provide you information as to a co-sponsor. Everyone has given you good information so far! Oh, just a comment about transferring over credits, this is not a given at all. Matter of fact a lot of Canadians who are looking at furthering their education while here, still have to have transcripts read and evaluated. Not if it's high school, but if you're thinking of taking post-secondary and then transferring.
