I am in the USCIS blackhole & need some advice.

I originally filed my AOS/EAD/Advance Parole applications on 3/3/08. The applications were returned to me 2 weeks later as I had put a signature in the incorrect box (as a preparer instead of as the applicant...rats!) I promptly sent back my application with a new (correct) form on 3/17/08. I called 7 days later only to find out that they were again returning my application - but they would not tell me why. I have yet to receive my rejected application in the mail!!!

I have called multiple times only to hear the same robotic answer: please wait 30 days and an inquiry will be placed. So I did that & now they are telling me to wait another 30-45 days from April 28th until I call back. This is ridiculous! I sent in my corrected application nearly 8 weeks ago & they can't even tell me if they know where it is.

I asked today if I could just refile using a copy of my NOA2 - at first the guy said NO NO NO....then when I asked what I was supposed to do & if I could talk to his supervisor he said "Do whatever you want & No you can't talk to my supervisor because he won't tell you anything different than me".

I am ultimately frustrated. I don't even know what was wrong with my corrected application...I completed it using VJ & a book on Fiance Visas.....

Does anyone have any advice? I am getting desperate!

PACKET NEVER ARRIVED _ LOST AT USCIS....WAITING FOR EXPLANATION/INSTRUCTIONS

5/12/08 Sent a new application with cover letter explaining situation

5/19/08 NOAs

5/20/08 Check cashed...FINALLY

6/10/08 Biometrics

6/20/08 AOS transferred to CSC

6/23/08 AOS touched - again 6/30 (probably received in CA)

7/9/08 AOS touched

7/10/08 AOS touched...come on CSC :)

7/18/08 EAD approved!!!!!! Card prodution ordered (67 days from filing)

7/28/08 Email saying EAD card mailed out today....but it was in the mailbox when I got home!!!!! Finally!!!

8/15/08 Welcome Permanent Resident Email

8/20/08 Email that AOS application is approved!!!! (100 days from time final application sent)

I'm so sorry you are going through so much hassle. Have you tried making an infopass appointment, that might be able to shed some light.

The info provided is a little confusing. You applied for AOS(sent it to the Chicago Lockbox?) but they sent your application back to you for wrong signature...then you corrected it and sent it back to them, and now they're supposed to be sending it back to you, but you haven't received it back, and you're not sure where its at? Am I understanding this correctly?

So have you reveiced a NOA1 for your applicaiton...i.e. do you have a case # for your AOS application? Has your payment check been cashed? If not, how are you trackink this application, to know that it has been send back to you again, after you initially corrected it and re-sent it? When you re-sent the application, did you use certified/return receipt mail? Do you have confirmation of that delivery?

Infopass for what? It sounds like OP hasn't even gotten his NOA1 and case # for his application, so there would be nothing to reference at an infopass appointment.

Yes - your summary of our situation is correct!! (sorry if it was confusing). We never received an NOA1 (nor have they cashed the check), although USCIS did confirm that they received our corrected application over the phone. They said, however, that another error was found & that is was being sent back to us. What little info we do have about our case is from squeezing it out of the "customer service" reps. My husband & I think we found the error in our packet yesterday - I missed line 10 on the I-864...grrrr.

The main problem is that we have NO idea where our application packet is. USCIS is saying it was mailed out on 3/28, but we have yet to receive it. Unfortunately (yet not surprisingly) USCIS does not track the packages they mail out, so they don't know (or aren't telling us) whether the packet is lost in the mail or at USCIS.

We made an Infopass apt for the 19th so hopefully we get an answer there. In the meantime, I think we are going to reassemble our packet with our corrected forms and a cover letter explaining the situation. If our application is truly lost by USCIS (it happens - I understand) this is probably what they would have us do. I'm hoping this works & we can make some progress soon. My wonderful husband is getting bored not being able to work!!!

Thanks for the advice...I'm all ears if anyone has anything else to add!

An Immigration Officer will be able to tell them whether to completely send their application again or not. The information line workers seem to be giving her mixed/unclear messages about what to do. "Do whatever you want" isn't helpful. While they may not have a receipt number yet, if it has been entered into the system at all (which it appears it has been because otherwise there's no way they could pull up their file when they call the 800 line), an IO will be able to see far more information and give them better advice. They clearly need to know if they should refile the whole thing again or not, and no one is giving them a good answer.

I would try as well to speak to an IO asap. If you are persistant enough, they can connect you with one just by calling the help line.

I did this twice and I got at least some more information about the status of my case.

I hope, you will get some clarification on the status of your application soon!!!
