Hello everyone,

I wanted to ask you smthg, the waiting time is killing us (I know some ppl have been waiting for longer than us but I'm not patient), can I go live with my fiance while waiting for NOA2? Or would it be a pb for immigration officer in airport or for the general process of my visa? :(

I came to the US to live with my fiancee for about the last 4 months of the process. I just told them immigration officer that I was coming down to visit until the date on my return ticket or until I got interview, at which point I would return to Canada to finish the process. All I was asked for at the border was proof of my return ticket.

Timeline

You may visit your fiance during the process (i assume you're the beneficiary?) as long as you enter the country legally. You'd have to get a visitor's visa if you're not from a vwp country (sorry i'm not sure if France is). You may stay as long as that visa is good. Be very careful not to overstay or you will be screwed. Many people visit during the process though, so why not you?

Many foreign fiances have visited the U.S. while the K-1 is processing, there is always a risk to be denied at the POE if the officer has any doubts about your intentions to immigrate permanently.

Thank you all for your answers^^ I wasn't sure coz I was afraid the immigration officers would get suspicious that I stay during 3months. Luckily France allows me to stay there 3months w/o a visa :thumbs: I don't want to mess up the whole process :dead: I feel relieved now ^^

Maybe I can use that time I'll be there to prepare the wedding lol

Looking at your timeline, you should be getting the NOA2 very soon (like any day now.) Many Vermont filers with March dates have gotten theirs. Before you hop on a plane to stay in the USA for 3 months, be sure you're prepared for the next part: your police certificate, birth certificate translations and immunization records...things you might need to be at home to arrange.

Visiting shouldn't be a problem if you just say "I'm coming to see friends."

I hope it gets approved soon :( If I do go it won't be before june, I'd need to get everything ready in case the form is approved. Hopefully the form will get approved by then.

I have the police certificate. I need to ask for the birth certificate but I don't have my immunization records :o They got lost when i moved. I hope it won't be a problem.

Upon his return in Dec, he was told to wait longer between visits next time. No reason given as to why. He explained he was here to visit his girlfriend. Is there any reason they would refuse him even if I could verify his reasons for visiting in, say, the end of May or June?

He was basically giving you a warning. Saying that visits so close to each other and for the max amount of time may alert the poe officer of the intent to immigrate. If it's not for long I wouldn't worry about it too much. However, every official is different so be certain he always takes proof of returning home, is always honest and doesn't offer more than what he is asked. If questioned about the intent he should probably mention he is in the k1 process and doesn't plan on messing that up. ;)

My SO was denied entry in Sept 07 but that was after the 5th entry in a year and each time he stayed about the 90 day limit.

I think you're due to be approved. Have you been checking your case status online? At least 21 K1 petitions with dates later than yours have been approved. The people with your exact same dates---sent and NOA1--- were approved yesterday. Another couple with late February dates were approved today. Your file has to be in the same box with theirs. It looks like VSC jumped ahead and got a lot of us mid March people and this week somebody found the late February people and are working on them. Just a hunch.
