Out of touch with process

Hello,

Sorry, after the intial hoop jumping for the K1 process I just wanted to forget everything. Well, I think I did too good a job because I'm way out of touch with the whole process again. Anyway, my wife's two year green card will expire in Dec 2008. I was told we need to re-apply for the 10 yr on or around Sept. '08. Can someone please tell me if this is correct and what form(s) do we need.

Oh, also, at what point can she apply for US citizenship?

04/28/05 Visited fiancee for the 1st time

08/07/05 Visited fiancee for the 2nd time

08/09/05 Got engaged

08/27/05 Submitted K1 to CSC

08/30/05 CSC received I-129F packet

08/31/05 Received NOA1 in mail

09/02/05 Check cashed

09/03/05 Received NOA1 via snail mail

Application window opens 90 days prior to expiration

Citizenship can be available at 3 years if all qualifications are met (if still married to the USC) or 5 years if not

yes, your wife and you need to submit a joint petition - form I-751 - to remove the conditions placed on her residency. You can file this anytime during the 90 day window before your wife's green card expires in December. The purpose of the form is to show that you have a valid marriage that has co-mingled financial and social aspects of your lives and that it isn't a marriage of convenience for the purpose of gaining immigration benefits. Along with the form you send in evidence to verify your valid marriage, the appropriate fees and copies of her green card. The instructions for the I-751 contain a good list of what is considered valid evidence. After the application is received, you will receive an NOA extending the validity of your wife's green card for one year, followed by a biometrics appointment to take a new photograph and redo her fingerprints. When the I-751 is processed, they will issue her a green card good for 10 years. The majority of I-751s are approved without an interview, but an interview is always possible.

Your wife can apply for citizenship starting 90 days prior to the third anniversary of getting her conditional greencard, whether the I-751 has been approved yet or not.

In addition to the info already provided by fwaguy and Kathryn, be sure to download the most recent version of the I-751 from the USCIS website when you're ready to file. We've had several VJers whose applications were returned just because they used an older version of the form.

08/17/08: Mailed N400 to TSC

08/19/08: USPS attempted delivery

08/20/08: TSC received N400

08/21/08: TSC cashed check

09/02/08: Received NOA...........Priority date: 08/20/08

..............................................Notice date : 08/22/08

09/02/08: Received Biometrics Notification

09/18/08: Biometrics completed - Charlotte DO

10/24/08: Received Interview Letter

12/08/08: Interview @ 1:00pm. APPROVED!

01/05/09: Oath Ceremony 10:00AM. Now officially a USC!!!
