Hello to All!

My passport was stamped permit to stay until June 25. Got married on April 8. I have not applied for AOS. When is it proper to send application? Can I hold on until 1st or 2nd week of June? I have no plans of working nor going out of the US for the next 12 months. Thanks in advance.

Note: I have started reading the tips on AOS process.

July 2 - Mailed I129F

Nov 20 - Approved K1 Petition

2008

Feb 1 - Medical - St. Luke's

Feb 8 - Interview - USEM

Mar 19 - Visa Received (6 weeks on AR)

Mar 27 - Arrived in Barlow, Kentucky

Apr 08 - Married in Wickcliffe County, Kentucky

Adjustment of Status

June 24 - Mailed I-485 and I-765

July 01 - NOA1 (Mail received July 05)

July 03 - ASC Appointment Notice for Biometrics on July 23

Nasville TN (Mail received July 8)

July 21 - Mailed I-131

July 23 - Completed Biometrics St. Louis, MO ASC

July 25 - I-485 Case Transferred to California Service Center

(Mail received July 31)

Aug 18 - Approved I-131 Application for Travel Document

Aug 21 - Biometrics Re-take at St. Louis, MO

Aug 23 - Received AP Papers

Aug 29 - Received EAD Card

Nov 18 - Green Card Production Ordered/Notice thru e-mail

Nov 25 - Received Green Card (Expiring Nov 6, 2010)

Removing Conditions on Residence

Sept 01 - Check Encashed/Deposited

Sept 04 - Received NOA dated Aug 30

Oct 12 - Received Biometrics Appt Notice

I believe you go "out of status" once your K-1 expires but since your married your fine to hold off as long as you need to. many just file right away so they can work and leave the US and get their green card as soon as possible. I believe the sooner you get your green card the sooner you can apply for citizenship

May 2nd, 2008 -- Visa Interview = Approved. (91days)

May 27th, 2008 -- Damian moves to America!

July 23rd - 30th, 2008 -- Damian's Mum Comes to the US for our wedding.

July 25th, 2008 -- Wedding Day!

March 16th, 2009 -- AOS Sent

May 8th, 2009 -- EAD & AP Approved (51days)

July 14th, 2009 -- AOS Approved!! (118days)

July 21st, 2009 -- Green Card Received (125days)

No RFEs the whole process :) All done myself.

December 4th - 30th, 2009 -- Visited England

April 8th - 30th, 2010 -- Damian's Brother visits us here in PA.

January 19th, 2010 -- Damian got his PA license.

December 10th - 19th, 2010 -- Visited England

September 16th - 30th, 2011 -- Damian's Parents came to visit us here in PA.

June 1st, 2011 -- Mailed ROC to Vermont.

February 21st, 2012 -- 10 Year Green Card Received

April 14th, 2012 -- N-400 Sent to Dallas Lockbox

November 26th, 2012 – Damian Became a US Citizen!!!

It is best to apply for the AOS as soon as possible,even if your plans dont include leaving the country or working.

Being out of status is not the best thing int he world (I myself was out of Status for one month and did not have a SSN# and I was not able to do anything drivers licence and co.)

So just as an advice apply as soon as possible.

Your belief is one of the most common errors we see. A K1 visa's expiration date becomes meaningless once the visa is used to enter the US. The "visa" is dead at that point. "Status" is derived by the I-94 (good for 90 days). When the 90 days is up, you're out of status but there is no stated penalty for failing to file AOS before the 90 days is up. Nevertheless, the sooner you file, the sooner you can work, travel and have permanent resident status.

In practice, the K1 expiration date could be up to 89 days sooner or up to 89 days after than the I-94 expiration. In any event it is meaningless once the visa is used it's one and only time.
