How soon or at what point does this get paid, immediatly after entering USA or before ,or is it with in the the first 2 years, for a k1 visa ?

Thanks

Once you have arrived in the US on your K1 and you have got married (within 90 days of your arrival) you then apply for AOS... it is at that point that you have to pay the $1010.00 fee... this fee includes the Biometrics fee and the cost of EAD and AP...

You are under no obligation to file for AOS before your I-94 expires.... your Visa (K1) expires when you enter the US... all you are obligied to do is get married within 90 days.... it is up to you when you file for AOS.... that could be before your I-94 expires or after.. it makes no diffrence to your AOS...

Is there a time limit for when you have to AOS? I take it you cant leave it too long once your 90 days has lasped.

There is no time limit for doing AOS.... but you will be out of status once your I-94 has expired and you have not filled for AOS.... but any out of status time is forgiven if you are married to a USC....

Some people have waited years to file for AOS.... just remember that you can not work or leave the US and re-enter until you have filed for AOS and your EAD and AP have been approved....

The cost of filling for AOS and EAD and AP is $1010.00 and yes you just send one check with your application. If you apply for EAD before you file for AOS the EAD would only be valid for 90 days from the date you enter the US, at the moment it takes USCIS about 90 -100 days to approve the EAD so if you were to apply and pay the fee for a EAD based on your K1 it would expire before you even got it and you would have lost the $$$ you paid.
