Hi again all,

I have my portion of the K-1 complete, and I am now waiting on my fiance to mail me her portion. During my discussions with a friend that is in process of K-3, he says if your passport will expire in less than five years, I man have to get another passport.

When he told me this, it sounded like normal visa rumor and misinformation, so I knew where I could get correct information...here! I searched the USCIS website and didn't find any info that would help.

My passport expires in 2010, is that an issue?

NO

First of all the USCIS does not care as they do not issue visas. The State Department typically wants the passport to be valid for 6 mos. longer than the expiration period of the visa.

What you friend is indicating is that the form says a passport that is valid for 5 years or longer. What is meant by this is the initial validity period not the remaining.

fwaguy is right

the passport needs to be valid for at least 6 months after visas expiration date.

Since K-1 visa is valid for 6 months a year of the passport life should be enough.

If you have to years however i would consider renewing it. You will need a new one when you are in US and sometimes it cost more to get passport from consulate...
