We want to have the celebration of wedding in Canada. What ca we do.

You can:

1. Apply for AP after getting married but you'll have to wait a couple of months to have the celebration and go back to Canada.

2. Have the celebration before the wedding ;)

My fiance and I decided to have a religious blessing and celebration in Guatemala before I leave. (In Guatemala religious ceremonies- blessings are not considered legal weddings) My immediate family and closer friends will travel to the States for the wedding but my extended family and co-workers wont make it, so we're having this celebration to share a special moment with all of them.

You have correct answers about Advanced Parole. However, whether you can do the "celebration of wedding" before she leaves for the US depends on exactly what you mean by the term in quotes. Marriage laws are somewhat unique in Canada in that nearly all religious marriage ceremonies are considered legal and binding if performed by a person authorized to perform legal marriage, even if no license is procured or marriage legally recorded.

If you just want to have a party to celebrate, I suggest you celebrate the upcoming marriage before she uses the single entry visa, or wait until she has AP. The consequences of mistakes in this regard are pretty severe.

The consequences of mistakes in this regard are pretty severe.

:yes: I agree. A couples of days ago a post was made of a couple who brought their wedding celebration- religious wedding pictures to the K-1 interview! Very bad idea! :wacko:

We plan to get officially married in Canada.

You can't get officially married in Canada and then expect to enter the States on a K1 afterwards.

K1 visas are for non-married fiance's coming to the U.S. to marry their USC fiance in the U.S.

You cannot get married outside the U.S. on a K1.

You can get married in Canada if you wish, and then file for a spousal visa.

We plan to get officially married in Canada.

One of the cast in stone requirements of the K1 visa is that the marriage occur in the USA.

The whole reason the visa exists is for a US Citizen to bring their fiance(e) to the US for a marriage within 90 days.

If you marry in Canada, you will be unable to provide a marriage certificate for a marriage in the USA, when filing to adjust status to permanent resident for your then spouse. She'll need to return to Canada an you start over again with a spouse visa process.

If you want to marry outside the USA, do not petition for a fiance visa.

A K1 visa is invalid for a married person, whether the marriage occurs before or after entering the USA.

Marriage before entry invalidates the visa or the visa process. Check the penalties for a spouse fraudulently using a fiance visa to enter the USA.

After the whole process in us I-485 approval. Do we have difficulties to fly to canada and have a party there and comeback?

Yes but unless your official marriage is in the USA, you will not complete the I-485 status adjustment process. K1 requires marriage in the USA.

You do not need to wait until your GC is granted (after getting married in the U.S. with the K-1), you can file for advanced parole as we first advised you to.

I dont' know if I should start a new tread. I am starting to think about marying in USA. Thing is we want to know each other more before to get married. I was thinking to have some visa to saty a 6 monts + starting the K1 process if we decide to marry. What visa can I apply that will let me stay all that time? I already have plane ticket to go there this summer, I don't know what to do: if I can go visit 1 month and comeback and apply for a visit visa to saty until we marry.

I think what you need to do is study the guides to familiarize yourself with the options.

If you are a Canadian Citizen, you don't need a visa to come to the USA and visit for as long as six months. If you marry and you husband files petition for a spouse visa, you may still remain for the remainder of the initial six months and potentially go home and visit again. You are allowed six months each year and a new year will begin about six months after this summer. There is no gaurantee you will be admitted for the second visit with an spouse visa process pending. There's lots of discussion to read on visiting during the process, so read those too.

Your profile indicates a K1 visa but you have no timeline. Has a petition in your behalf been filed for a fiance(e) visa?
