Hi guys,

I was wondering if there would be a problem if my fiancee was denied a visa before. She tried to get a tourist visa about 2 years ago. The petition was done through her sister who lives in Boston. Of course she wanted to come a visit me as well.

i guess thre would not be a problem i was once denied lastyear for a tourist visa now we upgrade it to a fiance visa..

as long as you have a strong connection or ties together bet. your country and u.s

She will be fine. Prior tourist visa denials have no effect when applying for a K-1, as long as you meet all the requirements for K-1, there is nothing to worry about.

08.01.2011 - I-751 SENT

08.05.2011 - Check cashed

08.08.2011- NOA Received

08.19.2011 - Biometrics Letter Received

09.12.2011 - Biometrics Appointment

01.27.2012 - Card production ordered

02.01.2012 - 10 year GC Received

07.25.2021 - N400 filed online

08.09.2021- Biometrics re-use notice

04.18.2022- Interview done at Minneapolis USCIS Local Office   ✔️ Received N-652 "Congratulations your application has been recommended for approval" during the interview.

I was wondering if there would be a problem if my fiancee was denied a visa before. She tried to get a tourist visa about 2 years ago. The petition was done through her sister who lives in Boston. Of course she wanted to come a visit me as well.

I don't believe this will have any impact on a K1 visa petition. They are different visas and serve a different purpose. My fiance had also previously applied for a tourist visa, and his country, about 85% of the folks who apply, get denied. I would be curious to see if anyone has more specific experience with this, but as far as everything I've read, as long as you're honest, and note your past applications on your petition, it should be fine.

01-24-2008 = Sent I-129F to CSC

01-29-2008 = NOA1 Issued

05-28-2008 = NOA2 (125 days after NOA1)

06-02-2008 = NOA2 Hardcopy received; NVC received petition

06-04-2008 = NVC sent package to Costa Rica

06-10-2008 = Embassy received

06-13-2008 = Picked up Packet 3

06-25-2008 = Interview (28 days after NOA2)

07-05-2008 = Home to the U.S. together!

09-20-2008 = Wedding!

AOS/EAD/AP TIMELINE:

10-15-2008 = Sent giant packet to Lockbox

10-22-2008 = NOA1's Issued

11-04-2008 = RFE on AOS only: need birth certificate, ORIGINAL was taken at interview. GRRR

Previous visa denials will not affect your chance of obtaining a K1 visa and I speak from experience. My husband was denied a tourist visa several years ago. He wanted to obtain a visa to come and visit me in the U.S. and it was denied. When the time came to travel to Ciudad Juarez, Mexico for his visa interview, he told the truth on the forms though. He put that he had previously been denied a visitor's visa and this was NO PROBLEM AT ALL. In the interview, they asked him about it and it was no big deal he just told them that he had been denied a visa.

Please do not worry, because it will not affect you as long as you tell the absolute truth. Look at our case: my husband has now been in the U.S. for about a year (in 2 days it will be a year since he arrived) and he is now a permanent resident! :thumbs:
