IS it better to do the AOS or the Consular FIling ? Consular filing- something new - no clue about

i am so confused

some places say you need the Affidavit of support before the Immigrant Visa is issued some say its needed for the AOS

AOS and getting an immigrant visa are 2 separate processes. Those who are in the USA, go through adjustment of status. The ones living outside USA are getting an immigrant visa. In both cases petitioner is in the USA.

Consular Filing results in an immigrant visa but petitioner lives overseas and papers are sent to a consulate instead of USCIS.

You get an immigrant visa or adjust status, not both. DCF results in an immigrant visa but both husband and wife must live together abroad to file DCF.

It is best to apply for AOS as soon as you get married, that way you avoid paperwork being denied. A few on this site have experienced denials because they let a month pass after they were married.

This is a K1 fiance visa answer. Not any kind of already married answer.
