My foreign Fiance is Unemployed

Hi all!

My fiance and I are in the first steps of filling out the forms for the K1 VISA, nervewracking to say the least!!!

he lives in Guatemala and on of my concerns is that he is currently unemployed and has been for a couple months...

does this weigh in on our application?

Absolutly NOT.

The Consulate is concerned with the US citizen's employment and income situation to support the prospective immigrant when they arrive in the USA.

The US Citizen will supply income data in the form of an I-134 at the visa interview, they will NOT provide this to USCIS when filing the I-129F

Hi Cela

As long as YOU meet the 125% poverty level for the affidavit of support there won't be a problem with your application.

How much - if anything - the beneficiary earns is irrelevant to the USCIS.

We were both unemployed, but I still qualified under assets, I just told the officer we both needed to go back home so I could get a job, which was the truth.

Just make sure you can qualify to support your spouse by assets or get a co-sponsor.

Honestly, my SO was employed; but what he made in comparison to US salaries was a joke. And, the process basically forces them into unemployment.

It does not matter.

It doesn´t matter if your fiance is unemployed. Anyway, salaries in poor country are very very very low compared with US salaries.

Don´t worry about that and good luck in the whole process.
