K3 awaiting interview date CR-1 approved and NVC asking for DS230 I-864

Timeline

General throw out to all interested paries to ponder and comment on.

I am proceeding with a K3 in the UK , had the medical but not given an interview date yet (though due soon im fairly sure)

We also pursued the CR-1 route and it appears to have caught up Portsmouth NVC having just sent a request for another affadavit of support form for my wife Lisa to complete and a DS230 for me

Im in the US on a short break and heading back to London this week , not sure if i should abandon the K3 and just pursue the CR-1 now as it will save on AOS fees later plus id effectively be able to start working sooner.

Any thoughts on options ? what I was intending to do was as follows ...

1. Complete and return the CR-1 I-864 and DS230 forms as requested

2. Attend K3 interview..<hopefully get K3 visa>

3. Come in on K3 but not adjust status as yet

4. Travel back and forth as I have been doing (I run a business in the UK) not ever had any issues travelling to US and back.

5. Go back to London for the CR-1 interview when asked to.

6. Finally immigrate and set up new business here.

Now what im not sure about is if this is do-able or will entering with the K3 throw a spanner in the works ?

I would say it's either abandoning the K3 or if you are going back and forth anyways, you can get the K3 and come back for CR1 interview. But you are very far in the CR1 process so maybe waiting would be good.

You can do the K3 and then CR1 if you want to but you could wait a bit longer and just do CR1. After you send inn the I864 and DS230, it's almost off to the embassy already!

July 17 2006 - Interview in Germany

Aug 02 2006 - Flying back to Tulsa with my CR1 in passport

Removal of Conditions - I-751

May 2 2008 - Mailed I-751 to TSC

May 21 2008 - Received NOA 1 (extension letter) from VSC

May 27 2008 - Biometrics Appointment in OKC

July 22 2008 - touched

August 6 2008 - touched

February 22, 2009 - touched

March 24, 2009 - card production ordered

April 4, 2009 - Green Card in mail

I-129F

Aug 31 - Oct 20 2005at NBC

Oct 26 - Nov 3 2005 at NVC

Jan 10 2006- Visa interview

Feb 09 2006- Flying to Tulsa

On thinking about it I guess the question could be distilled down to if i get the K3 and enter the US with it

does the CR-1 process thats in place stop and MUST I then follow the AOS route or can i just carry on coming and going and simply wait for the CR-1 to hit the London Embassy ?

Many on here enter the US on a K-3 and continue the process of the I-130 through NVC culminating in returning to the embassy for the CR-1 visa. You dont have to do AOS if you are wishing to return to embassy to interview for the CR-1.

Many on here enter the US on a K-3 and continue the process of the I-130 through NVC culminating in returning to the embassy for the CR-1 visa. You dont have to do AOS if you are wishing to return to embassy to interview for the CR-1.

If you don't find anyone replying to your question above, you may want to start a thread under the Regional Discussion (UK) asking your question. I think it's best if you find someone in that situation from your own country.

That's what I sort of did except I looked up people in the Immigration Timelines section. I looked for a Canadian who entered the US on a K-3, NOT adjusted status then gone back for the CR-1 interview. I was able to find one person and emailed her (I don't think she's been active here at VJ lately as her case was completed awhile back). She is really nice and assured me that coming back for the CR-1 after entering the US on a K-3 was very possible as this was what she did.

thank you very much , puts my mind at rest about how to proceed and a tad annoyed at the ignorance of supposedly the best immigration lawyer in WA who didnt appear to be sure of his facts !! to be fair and humourously objective however he does not and never claimed to have method of seeing the future <chuckle>
