This just sorta of came to me today. I've seen service centers transfer cases some of the time, and send back cases other times. IE. Nebraska and Texas were transferring back in July and August then just decided to turn off for awhile and now for instance i've seen a February filers case sent to NSC transfered to CSC.

I had sort of heard through the grape vine, that USCIS is supposed to transfer when they can and that its technically against policy to send back petitions.

In my case, I've had CSC transfer a case in error to Chicago. Chicago knowing the application should be in CSC instead decides to file a rejection and sends it back to me. I'm guessing that Chicago broke protocol.

Wow I am so sorry to hear about this. I imagine you may be a little furious due to all the time you have had to wait and all the problems that have come up.

The only think I can think of us to call bout your case and do whatever you can figure out the situation. If you keep having problems then inquire your local representative.

I'm not sure I fully understand the question, but just to check -

you're aware that at the time of the fee increase (end of July 2007), Nebraska and Texas stopped processing K visas? K petitions that were sent to either of those service centres after that time were automatically transferred to either California or Vermont... when I read the official policy at the time, it said something about continuing to do that for a month or so (can't remember the details), and after that mis-filed petitions would be sent back to the petitioner to re-send to the correct service centre, but I haven't heard of that happening to anyone so perhaps that part of the policy changed...?

our petition was sent to Vermont, which was where it was supposed to go according to USCIS's own guidelines, but was then transferred to California... still have no idea why :lol:

Nebraska and Texas stopped processing K and CR/IR visas more than two years ago, so all such cases sent to them were tranferred to CSC or VSC. Chicago has never had a service center. There's only a mail lockbox and a crew to open and transfer cases, no adjudicators.

Facts are cheap...knowing how to use them is precious...

My question is simply -what is the the protocol for transferring. Not about where why or how, just simply the protocol. IE case file A arrives at station C. case file A needs to get to station B. USCIS seems to transfer on a whim more then any set policy but there has to be a some sort of official policy. I rather doubt its supposed to be at the digression of the individual who happens to have the file at any given moment (officially).
