My wife has entered the US with her K3 visa and we are filling out the AOS forms. We have a couple questions and would really appreciate some help.

1. On the I-485 (Part 2), what is the application type for a K3 visa holder? It's obvious for K1s, but not so obvious for K3s.

2. My wife of course had to pass a medical exam to receive her visa. The examination form was sealed with the documents she submitted at the POE, so we do not have a copy. Do we have to get another examination or can we obtain a copy of the original examination record? If the latter, where do we send our request?

Thanks very much for you help!

1) "A" based on the approved I-130, and attach a copy of the I-130 NOA2 letter.

2) K-Visas only need a vaccination supplement because the visa medical is less than a year old.

Thank you very much for your help. One more question about the I-485: Does the "expires on" date refer to her visa or the I-94 (the date on the stamp)?

Thanks again!

Yep, that is the I-94 expiration date.

There are some more questions.

I-485

1. What is it A# and if my wife has it?

2. Were you inspected by a U.S. Immigration Officer? Is it YES?

3. G-325a: What is Alien Registration Number and if my wife has it? Where we can find it?

4. I-765: 14. Manner of Last Entry (Visitor, Student, etc.)? Is it VISITOR?

15. Current Immigration Status (Visitor, Student, etc.)? Is it VISITOR?

5. Eligibility under 8 CFR 274a.12? Is it (a)(9)?

Thank you very much in advance.

1. This may be written on the back side of the I-94 card, or is on I-129F approval letter.

2. YES that is the officer at the POE.

3. See number 1.

4. 14. Other K-3 visa 15, K-3 visa holder.

5. C 9 "Based on pending I-485" if you use an "A" classification this EAD will cost you $340, "A" Class if for applying for EAD BEFORE filing for AOS, some K-3's do this to get work auth, and then file for AOS very close to 2nd wedding anniversary, to avoid getting the 2 year CR-Green card, many K-3s have need married over a year before getting the visa, so waiting a few months to file the I-485 can save them the added hassle of the conditional green card.

You don't usually need a new medical if your visa is less than a year old. I believe this is true for both K1's and K3's. You just need the supplement, and you should be able to find a doctor who will transcribe your vaccination record to a new I-693A form for a small fee. We paid $25 for ours.

Correct, this is true for all K-Visas, though the wording in form I-485 directions tends to make it look like just K-1/2, this wordign has not been updated to cover the life act K-3/4 visas.

K3 Visas are a little different. K1 only requires the vacc supplement. K3 applicants must get a stateside physical because some overseas countries don't have all required vaccs etc.

1) "A" based on the approved I-130, and attach a copy of the I-130 NOA2 letter.

2) K-Visas only need a vaccination supplement because the visa medical is less than a year old.

K3's do not need a complete medical if it is less than 12 months same as the K1'a, only need the supplement.
