Thought I'd just remind everyone that it's coming up to tax filing time again in the US ..... and for those who don't know, but would like to file jointly with their spouses can, even without a SSN.

The link below takes you to the W7 tax form for you to fill out and send to your spouse. Print off the pages and read the instructions carefully.

As a foreign national not living in the US you can still file jointly as married.

I have personally seen a benefit to this as 'possibly' it will mean more of a tax refund, and also a copy could be sent in with your AOS financial form ..... therefore showing more proof of a marriage in my books.

It makes another financial tie which I feel would look good.

Make sure you keep photocopies of all forms sent to the tax office! .... more stuff for you to take to your interview just incase :thumbs:

As a foreign national all you have to do ..... according to the instructions attached to the form .....is send with the W7 a certified copy of your passport. This covers all the necessary identification documentation and proof of foreign nationality ..... you will not need a SSN.

Therefore, you should be able to find a lawyer who can do this quite cheaply for you in your own country.

In England ..... for those from here, it is costing me £5 to get each document certified .... I'm going for biographic page and the cover of the passport .... so it will be £10 .... I can't see it costing £100's, but do call around.

They're not asking for it to be notarised .... only certified.

Send the form and certified copy of your passport ASAP to your spouse in the US (I'd use a postal service which requires a signature at the end, to make sure it gets there) and all he/she has to do is send it with his/her tax form when filed.

You will then be issued a tax number in your own name ..... and it will be sent to the address which you enter into the applicant's mailing address section (I'm putting my US address in this section).

Just wanna add something...

For foreign national spouse, your passport need to notarized at your local US Embassy with exception for countries which are listed under the Hague Convention.

I did mine at US Embassy in Kuala Lumpur, Malaysia and it took me about 20 minutes. I paid USD 30 for it. Don't forget to bring your W7 form along and do not sign it.

What about the income of the nonUSC spouse? I was doing my taxes on turbotax and noticed that if I file "jointly" i have to issue something proving the spouse did not make income or if they did i needed tp provide documentation of the amounts. have you had this issue? Otherwise I have to file married filing seperately.

I sent public notarize copy of my wife’s passport. I hope it will work.

What documents are acceptable as proof of identity and foreign status?

IRS has streamlined the number of documents the agency will accept as proof of identity to obtain an ITIN. There are now 13 acceptable documents.

An original, or a certified or notarized copy, of an UNEXPIRED passport is the only document that is accepted for both identity and foreign status. If you do not have a passport, you must provide a combination of current documents that contain expiration dates - we accept docs issued within 12 months of the application if no expiration date is normally available. The documents must also show your name and photograph, and support your claim of foreign status.

IRS will accept certified or notarized copies of a combination (two or more) of the following documents, in lieu of a passport:

• National identification card (must show photo, name, current address, date of birth, and expiration date)

• U.S. driver's license

• Civil birth certificate

• Foreign driver's license

• U.S. state identification card

• Foreign voter's registration card

• U.S. military identification card

• Foreign military identification card

• Visa

• U.S. Citizenship and Immigration Services (USCIS) photo identification

• Medical records (dependents - under 14 years old - only)

i had mine done by outside source filing application for the w7 also and there was no mention of his income and for the presidents tax return the w7 holder will not receive (was what i heard) ours is jointly

Just additional info. of what my tax preparer told me................

to make sure I direct deposit my refund to my bank.......bacause I will get a hard time cashing my check ..If I didn't do so. it requires 2 signature.....eventhough your spouse sign the check.....some bank won't cash it ..not unless both name in the bank account. I don't know how true is this. But I won't take any chances, infact it's less hassle...........

I have my wife send me a passport......filed my federal. Filled up W7..........and took passport, W7 and marriage certificate to IRS office. Since I don't want to send original passport thru mail. it's way faster this way.......

If filing jointly, and your spouse has an ITIN (Taxpayer ID Number) neither of you can get the stimulus package payment.

A: No. The law does not allow stimulus payments to people who file a return using an ITIN. A taxpayer must have a valid Social Security Number to qualify for the stimulus payment. If married filing jointly, both taxpayers must have a valid Social Security Number. And children must have valid Social Security Numbers to be eligible as qualifying children.

don't forget stimulus package only 600 but tax retrun can be 6,000 people have to choose. But what if the IRS won't give an ITIN. will it be like file single

I was married last year and when i filed my taxes this year I just filed head of household and did not include my husband in any of my tax forms. The people who did my taxes told me I couldn't file for my husband since he is not a USC. Will this jeopardize my case since I didn't include my husband in my taxes?

ang its kinda far from where we live...

we already have a son so we can get a higher refund.. :yes:

Hi Ruby (F) ,

Do read all the instructions on the information which comes with the W7 .... I can only comment on certification of UK passports, and mine was quite simple and was done today .... I don't have knowledge of your country, so please post on here if you find it to be different in the Philippines.

I'm hoping for a higher refund too :dance: .... at the very least, it will show immigration that we're tied financially.

Am looking into the Military Dependant ID myself ..... not sure if we can get it while I'm outside the US with no SSN, however, I believe it's possible that we can be added to the DEERS system ..... Hubby is trying this week, with copy of marriage certificate and copy of my passport .... I'll let you know how it goes.

I've also requested a separate US Military Forum from the VJ site builders (don't know if it will happen), as our situations with immigration are slightly different in some areas (i.e. medical, citizenship, expedited processes etc.), and it may be good for us all to share our experiences with it. As well as building another support structure for those with partners on deployment. :wacko:

go to the internal revenue web page and it will show who can file under w7 and gives instructions (you could have) unless yours is very different and u can amend at a later time

Hi Sharif,

So my wife doesn't have to take her passport to the US Embassy (300 miles away from her place)? She can just have them attested from a designated government officer?

My tax returns are all set, I am doing them with Turbo Tax's office and this morning they called me telling that they wont be able to send my tax returns as there Notarizing Person is not going to notarize her passport'c copy (required for W7) without seeing originals. He suggested me that I should have my spouse get the passport copy notarized in her country and mail it to me. Now, I just read that US embassy in that country has to notarize her passport.

Please advise.
