B-1 Business Visa and applying for a fiance or spouse visa

Hi

I am hoping someone can help with this query. My firm have agreed to let me work from the USA and I imagine the B-1 business visa is the easiest one to enter the US on. My company is a multi-national and have offices in the US, but I imagine the H1B visa will take longer to get and is a lot harder to get issued. My query is whether you can be working in the US on a B1 visa while at the same time filing for either a fiance or spouse visa?

We are not married yet, and wish to look at which option will be quickest and as we dont want to be apart for longer than necessary moving with work seems like a good option. We wish to do everything by the book and want to find out if it would be a problem working in the US on a B1 visa whilst at the same time filing for a K1 or spousal visa.

If you can work from US & still get paid by the non US company, why not use VWP for temporary visit?

Next best thing you can do is email the consulate & see if your scenario will work. My opinion B-1 is usually for visit/training/meetings but not for regular employment.

Jan 11 2005 : Beneficiary received DS 3032 in Indonesia

Jan 31 2005 : Sent DS 3032 to NVC

Feb 8, 2005 : NVC received DS 3032

Feb 21, 2005 : IV fee generated

Feb 25, 2005 : Sent I-864 fee bill

Feb 28, 2005 : I-864 fee bill delivered to St Louis

Mar 3, 2005 : IV fee bill received

Mar 7, 2005 : Sent IV fee bill

Mar 9, 2005 : IV fee bill delivered to St Louis

Mar 28, 2005 : I-864 fee credited against case.

April 6, 2005 : Received I-864 package

April 7, 2005 : Immigrant Visa fee credited against case.

April 11, 2005 : DS 230 is generated

Aug 12, 2005 : I-864 & DS 230 received by NVC

Sep 14, 2005 : RFE on I-864

Nov 3, 2005 : Checklist response received at NVC

Nov 25, 2005 : Case completion

Dec 9, 2005 : Police Cert requested from the Netherlands

Jan 12 2006 : Interview success - Approved !!

Jan 19 2006 : Visa & brown envelope picked up

Thanks...just saw there is another visa option an L1 visa for intra company transfer - not really sure what this entails but might be another option.

That's right, B-1 is for attending bussiness related meetings, seminars, conferences, etc. B-1 is not a work visa.

Your company, as your sponsor for the work visa should be the one telling which visa you need to apply for.

08.09.2021- Biometrics re-use notice

04.18.2022- Interview done at Minneapolis USCIS Local Office   ✔️ Received N-652 "Congratulations your application has been recommended for approval" during the interview.

05.19.2022- Oath Ceremony in MN
