Can you live in the USA while waiting for visa

Hi all, just wondering, if you apply for the K1 visa can you live in the USA while its getting processed. I know I can't work and I would have to go back to Canada after 6 months or when the interview is which ever comes first. What about if we applied for a K3 visa if I got married down there could I stay there and apply or would I have to come home and wait.

first hi and welcome to the great canadian forum

sorry dont have the answer about the K3 , but as K1 applicant you can stay for up to 6 month ( I bet you will get the interview before 6 month though )

just show prove effidance that you live in canada when you cross the border ( like lease or bills )

when I was on that process I always traveld left and right without any trouble

Ditto Marilyn, that's what I mean. You can absolutely get married in the US anytime you choose; BUT if you enter with intent to marry it is indeed fraudulent.

the fraud comes in if you have intent to stay not with intent to marry. You cannot "live" in the US without a proper visa. You can however visit for up to 6 months, IF the CBP will let you in.

divorced - April 2010 moved back to Ontario May 2010 and surrendered green card

As for being able to cross the border without any problems, it is up to each individual border guard's interpretation. I know many people here have had no problems crossing while in the K-1 process. My then fiance was turned away at the border for not having proof of enough ties to Canada (bring as much evidence as you can of ties to Canada and proof that you are planning to return!). Also, while the border guard was deliberating, he asked us about the K-1 process (which we had begun) and told us that we were not allowed to visit during that process, that we had to wait in our respective countries until the interview date. Although that is not necessarily true, that was the guard's interpretation.

However, at a later date, my fiance was able to visit (although only for a couple weeks) and the guard at that time said that it was permissible to visit during the process.

Yes, and trying to explain it to the border guy that your marrying and not staying is pointless as they have no idea what your talking about. Read what happened to me by clicking on my profile and clicking on "My Story" He wasted 2 & a half years of my life.

On the other hand, everyone has a different POE experience!! I never had a problem!! There are no gaurentees,but many do "visit" with success

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1
