All,

Let's hope we can get some facts straight here. Are they doing away with the K-3 visa altogether? I have read several messages in different threads that the K-3 visa will no longer be honored? Are they abolishing the K-3 visa? I have not heard this anywhere or have been told this from anyone. Can someone point me to a legitimate resource that indicates this is happening or has already happened?

I'm really concerned about this as I was on the K-3 visa path for my wife. I am about to file the I-129F now that I have the I-130 NOA1. Please let us all know if this is real or just rumors.

All I can tell you is that when I called about mine. they asked if my fee was waived and when I said yes, she said that they were going to administrativly close my K-3 and process my I-130 when it was done. I can't get a straight answer from them about anything anymore.

If you search this site you will see that nobody really knows definitively, but people like you keep posting that their I-129F was canceled after 130 approval. I wrote my Senator asking about K-3 and still am waiting for an answer. i think Congress is still in recess so it may be awhile before I hear anything. When i do, I'll post what I find out.

Seems that for post July 28th filers, the USCIS has canceled the 129f once the 130 is approved. Some say this is good and some say otherwise. It depends on how much longer the 130 takes versus the 129F. I keep hearing the processing times have gotten to be about the same but it can depend on what Service Center or Embassy you're dealing with.

I've been advised by a lawyer (for what that is worth sometimes) that:

a) there is no adjustment to the I-130 receipt date when a K-3 petition is filed

B) It appears that in cases where the I-130 and I-129F (K-3) were filed concurrently, the K-3 is being administratively closed at the time of adjudication of the I-130

The I-129F isn't supposed to be filed without having received the receipt notice (NOA 1) from the I-130. I don't know if this has been the case for those who have had their I-129F administratively closed.

July 14th - biometrics

July 16 - cases available online

Aug 6th - card production ordered (EAD)

11.26.08 - Visa Journey is Over!! TOOK 737 DAYS....Habibi is Home!! :) :)

12.10.08 - Applied for SS Card

12.15.08 - Welcome Letter Received

12.17.08 - SS Card Received

12.26.08 - Green Card Received :)

Begin Naturalization process 2011 ~ Inshallah

Hmm .. yeah it sure would be nice to have all the information while trying to make decisions. How frustrating!
