Are Military personnel treated differently?

I was just wondering if anyone on this site may know if Military personnel are given any benefits as to the speed of I-130 applications?

My husband was Active duty when we originally met online, and has completed 2 tours in Iraq. He left the Army and became classed as a Veteran in June 2006. He is currently in the Army Reserve but is happy to mobilise as Active duty again if it will speed up the process.

I am in England and used to have a greencard 12 years ago .... silly me left the U.S. at the change over point when my 2 year conditions were to be lifted. In those days the application process was 8 weeks beginning to end.

The delays I'm seeing now are quite shocking and have been advised not to travel to the U.S. (London Embassy and Immigration Lawyer) for a visit while my I-130 is pending, even though it's not in the system yet (no check cashed, no NOA 1).

From what i read here on VJ the only way to have your case expedited is if your husband is about to be deployed.

Our Timeline:

08/20/07-----Mailed I-129F to CSC

08/21/07-----Recieved at CSC

09/26/07-----NOA1

02/06/08-----Touched (RFE Trick) and approved the same day.

02/07/08-----NOA2 VIA Cris E-mail

02/11/08-----NOA2 Hard Copy Recieved

02/25/08-----Received at NVC

02/27/08-----Left NVC

03/03/08-----Received at Embassy

04/03/08-----Interview! APPROVED!!! YEA YEA YEAH

04/08/08-----VISA In Hand!!!! WOOOO HOOOO!!!

04/18/08-----She's finally coming home POA IAD!!!

they wont do anything unless he's on Active duty and is up for deployment. Then they'll need his order in order to expedite the case. It doesn't matter how many times he's been to Iraq, my husband has been 4 times and will soon be looking at his 5th it doesn't matter...which sucks

I believe so.I have a family member who is in the Air Force and was getting sent to Europe.Her husband and son were on her "orders" and she was able to take them along with her right away.How lucky she was.

May 7,2007-USCIS received I-129f
July 24,2007-NOA1 was received
April 21,2008-K-1 visa denied.
June 3,2008-waiver filed at US Consalate in Panama
The interview went well,they told him it will take another 6 months for them to adjudicate the waiver
March 3,2009-US Consulate claims they have no record of our December visit,nor Manuel's interview
March 27,2009-Manuel returned to the consulate for another interrogation(because they forgot about December's interview),and they were really rude !
April 3,2009-US Counsalate asks for more court documents that no longer exist !
June 1,2009-Manuel and I go back to the US consalate AGAIN to give them a letter from the court in Colon along with documents I already gave them last year.I was surprised to see they had two thick files for his case !


June 15,2010-They called Manuel in to take his fingerprints again,still no decision on his case!
June 22,2010-WAIVER APPROVED at 5:00pm
July 19,2010-VISA IN MANUELITO'S HAND at 3:15pm!
July 25,2010-Manuelito arrives at 9:35pm at Logan Intn'l Airport,Boston,MA
August 5,2010-FINALLY MARRIED!!!!!!!!!!!!
August 23,2010-Filed for AOS at the International Institute of RI $1400!
December 23,2010-Work authorization received.
January 12,2011-RFE

Feb 4,2007 - I-130 accepted > Get USCIS case Number NOA1.

May 8 ,2007- GET NVC Case Number > NOA2.

June 16 ,2007- Get Order from NVC to pay 70$.

July 2 ,2007- Get DS-3032 in India.

July 7,2007 - DS-3032 choice of address agent entered in NVC.

July 14 ,2007- Get I-864.

July 18 ,2007- I-864 Enters NVC.

July 29 ,2007- Get Order to Pay 380$ fee.

Aug 3 ,2007- 380$ Fee Reached St Louis.

Aug 25,2007 - NVC & St Louis People receive photocopy of my payment with USPS receipt.

After WAITING for 37 days.

Sept 10,2007 - 380$ fee encashed.

Sept 24,2007 - Receive DS-230 in Mail.

Sept 25,2007 - DS-230 despatched.

Sept 26,2007- DS-230 Delivered.

Oct 1,2007 - NVC has DS-230.

Oct 12, 2007 - DS-230 Reviewed. Case Complete

Oct 16, 2007 - Case at Embassy.

Oct 25, 2007- Interview Letter Despatched from Embassy.

Jan 16 - I am in USA

April 15 2008 - Get my Drivers License.

I-751 Lifting Conditions at California Service Center

November 12, 2009 - I-751 Sent via USPS Express Mail

November 13, 2009 - Receipt of I-1751 Fee

November 20, 2009 - Arrested on Domestic Battery(Had argument with wife)

December 18, 2009 - Biometrics Completed at 9 am.

January 13, 2010 - Receive I-797E Notice for more evidence

February 16, 2010 - Mail reaches Californa Service Center( Next day of Preseidents Day)

February 19, 2010 - Card Production Ordered. Status now IR1

Timeline

Military members are treated the same way as civilian unless the individual is subject to deploy. But the person needs to show proof and statement from 1st Sergeant and/or commanding officer. I was in the process for retirement from 22 yrs in the Air Force when I had started my application and I had no need to expedite my K-1 package. I had sent them plenty of my military documents though and I still got the RFE for my name changed. I changed it when I became naturalized US citizen otherwise I could not have served for more than 4 yrs.
