Gosh, it really is getting silly now. You need to get your story straight and be able to produce evidence to back up your claims. Present all this info and your NOID to an immigration attorney and go from there. A visit to the embassy in Vietnam and harassing the CO who denied your petition will not help you whatsoever.

The petition has been returned to USCIS, the onus is on you to provide evidence supporting your application. Do not waste this opportunity. Get help from an attorney because a mistake this time around will cost you far more than you seem to realise.

I am trying to get my Senator involve to see if anything they can do first. If not, lawyers are there for ppl like me. I know they want tons of evidence I can never submit enough to the CO. Actually, Vietnam is a corrupted country and many ppl are faking the relationship that affect me as a real one. If I were to petition a fiancee from Frence or other European countries, I don't think I have to go thru. this trouble. Another stupid reason is that I should NOT engage with anyone from far away Vietnam even though I am a Vietnamese. Oh well, I am totally stuck with this mess that I created.

What is the appx cost to consult a lawyer with my current case? Anyone can give me an estimate? I don't mind to put out couple of grands but I want it to be successful, not a failure.

Wrong. Anyone who misrepresents the truth on a visa application faces the possibility of denial at ANY consulate. You're still looking for excuses for your own mistake.

An initial consultation with a lawyer will set you back $200-400 probably. Nothing is guaranteed.

Don't give up!

I don't think it is so BAD as you feel right now.

It's a good step that you start looking for a lawyer.

You still can re-apply. K3 or CR1 are still available for your situation or even K1.

You will see that your lover will be able to be with you here in the US the in nearest future anyway.

BTW, stop saying you lied. What done is done, just learn the mistake and move on. You can start collecting evidence now for the coming process. For future use, you need to save all the phone bills when you call your fiancee, also you flight tickets, photos when you are in Vietnam with your fiancee. There are a lot of advices you can read here on this forum.

I wish you best luck for your Visa process.

Honestly I'm starting to think that you're a lost cause.

The only way that you personally are going to "convince the consulate officer to re-consider [your] case" is to provide the evidence they are asking for. But you can't provide that evidence because your meeting in 2004 never happened.

So your question really boils down to "is there any way I can convince the consulate to believe my lie?"

Call that attorney. You need someone else to do the thinking for you. You clearly are not up to the task.

Meeting her for the first time in 2004 wasn't mean that I was falling in love with her. I broke up with my gf here then I went back in 2006 to fall in love and petitioned her in March 2007. I didn't explain this in detail of question #18.

I thought you said you both got engaged in Dec 2006? Hmmm... I think the CO is more interested in any solid proof of communication (phone, emails) prior to your said engagement rather than the date you both fell in love.

There is no such thing as guaranteed success in life.

And I think you have again "misunderstood" the function of a lawyer. I don't think there is any lawyer will take on a case with a guarantee to his client that he will win the case. Normally they'll say " I do the best that I can" (too much TV show)

Yes, I gave them phone calls, yahoo message chats, pictures of the engagements. Those they think were not good enough. I have no other things to give. Of course, airline tickets and passport date stamped to prove the visits. Never enough to the consulate officer. They are challenging me if I am really in a committed relationship. I know I have done all of these petition by myself so there are mistakes. Now, I just have to deal with it. I will get my Senator involve if that doesn't help, lawyer is my next step. I guess I am not in a rush to get my fiancee over here. I got used to live a single life in the past 15 yrs since college life :)

By the way, there was a sad news from my old college campus yesterday. A gun-man shot 6 students and himself. Omg, god bless Northern IL University students !! My condulences to all of 'em.

Can you plz give specifics? So, you mentioned you know her since 2004 but have no supporting evidence until 2006. But knowing a person and engaging into relationship is not the same thing, right? I know my fiance since 2005 when I briefly saw her but in fact I started my relationship in 2007 and said in my docs that I KNOW her since 2005 but started communication in 2007. So, I believe it all depends how you put it in the document.

Scenario 1.

You said that you KNOW her since 2004. And didnt' say that you communicated to her thorugh that time until 2006. In this case, an immigration lawyer will clear thing easily.

Scenario 2

You clearly stated you communicated to her in 2004-2006 but didnt' provide support. Then, it is a matter of circumstances - what exactly did you say? This scenario is more difficult for you to resolve than the first one.

Please read question #18. I know what I said from the beginning wasn't what I intended in the application. As I look back to that question, I should explain more in details that I didn't have any relationship until 2006. That is the fact. The problem for me now is that there is no way I can convince the CO now.

It seems the NOID is based on the accumulation of all your evidence not just one thing. How many phone bills and chat logs did you send, cause they said you only sent a few. In 2 years or even 1 you should have a ton of phone bills or skype call history or chat logs to submit. You also mentioned you visited again in 2007 in Dec. You should give them all the evidence of that too. I think had you not had evidence of before 2006 but lots from 2006 till now they wouldnt doubt what you say. There may still be hope if you have lots of current evidence.

Hello all,

I am new on this board. Here is my K1 denied petition issue. Please give me any advice if you can. I was introduced to my fiancee in Vietnam in 2006 but I lied in my petition that I met her in 2004. I have no supporting evidence of the relationship between 2004 to 2006. I have evidence from 2006 until now. So, basically they rejected my application and saying that we lack of evidence since 2004. They want to return my petition back to the u.s. for appealing. They didn't tell me when will they return? I have no clue what to do next?

Any advice here? I did the petition all by myself. I didn't go thru. lawyer or service agent. Now, it is too much trouble and headache for me. Helppp. I wrote a letter to my Senator, do you think they can help out my case?

You're not lost. The OP keeps changing his story. I've pretty much lost all compassion at this point, and the outcome to this whole sordid little scandal seems foregone to me now. I'm only sorry that a most-likely innocent woman will have to suffer through all the lies and deceits.

Totally agree with you. Looks like the system worked as it should in this case, that may sound like a harsh comment but I do think the onus is on the applicants to ensure there is no holes (evidence or storywise) in their petition. I also worry about the beneficiary. Aside from the comments you made, how will she fare if she ever wants to visit the US with a visa denial behind her?
