Do I need a Waiver

Hello everybody. My name is Diego, I´m from Argentina and this is the first time I post in this forum. I need some help please.

I entered illegaly to the US in 2002 (Tijuana-San Diego border). The same year I fell in love with Jane (US citizen) and had a great relationship with her until I had to leave the country (voluntarily) (and sadly) 3 years and 2 months later, in 2005.

She visited me here in Argentina on 2006 and we realized we still were very much in love.

On march 2007 she applied for the I129F. On october 2007 we met in Costa Rica (halfway point from Argentina and US:)

I sent all the documents to the embassy here and then they emailed me asking to wait until they schedule my interview.

January 16 2008 we got the email from the USCIS in which they say they have mailed the approval petition notice.

I still dont know when my interview will be. And have no clue whether I´ll need a waiver or not.

Does anybody have any idea? I really need a piece of advice.

Yes, you will probably will need to file for a waiver, but can only do this after you have visa interview and the counselor officer requests that you file a waiver.

Did you answer truthfully and declare your previous undocumented stay in the US on the I-129F petition? At the consulate stage there will be question(s) on forms requiring you to declare previous stays in the US. Under no circumstances should you reply falsely to any such type of question. You will probably required to apply for a waiver and it will be requested of you after you have your visa interview. The waiver you apply for will be based on the ban that is in effect for your particular length of undocumented stay in the US. You may want to do a little research on bans of entry what they mean and how they are enacted....just to be informed on the subject, if and when it becomes necessary.

I just left the US because I missed my family after more than 3 years without being able to see them.
