How many days I have to send back a RFE?

Hi everybody,

We will have our second aniversary in July 20. I have noticed that some cases took just 4 months to have the AOS interview aproved, in my case I sent our AOS in december and we received the NOA in January. If it take about 4 months problably we will receive the 2 years card and not 10 years and we will lose money aplying for lifting condition, then we would like to know if us received a RFE how many days we have to send it back without has the case abandoned or denied?

Please answer me, because I think we need one, If yes pray for us get a RFE.

01/23/2008 Biometric appointment (done)- They corrected my name ( I have 4 names and on the NOA they wrote just 3 names)

02/21/2008 EAD card ordered

02/26/2008 EAD card ordered (AGAIN???)

02/28/2008 EAD Aproved (it s very strange! did they order firstly and after aprove it????)

02/20/2008 interview letter sent (I just received it 5 days after the date)

03/03/2008 EAD card received

03/07/2008 SSN aplied

03/14/2008 SSN received

04/10/2008 Interview appointment - Aproveeeeeeed

04/15/2008 GC already ordered - Yahooooooooooooooooooo ooo ooooo!

ROC Sent

You have something like 87 days (a weird number like this, almost sure its 87) to have it RECEIVED by USCIS.

im not sure what u were asking but if im right you were asking about RFE

1. not everyone recieves RFE (request for additional evidence/info) why do u think u will get one? if u do get one then send it back immediately

2 regardless of how long it takes.. everyone has to apply for the 2 year card BEFORE they can apply for the 10 year card

i have been living here for over a year and i still have not got my 2 year green card

just wait on someone else to come answer cuz ur questions are rather confusing to me

I see you have a very confusing questions.

If you havent sent some supporting documents or have nt signed one of the forms or something that makes the USCIS to issue you a RFE then they will and its 87 days for you to send back from the date quoted on your RFE, So if you wanna hang into that RFE and send it according to your timing of 2 yrs anniv. its all upto you but the catch here is not everyone's case gets processed fast.. some are here for past 2 yrs and more and some get their interview or transfer and the GC within 3 months of applying. So its your luck and its all upto you to prolong your case or stick to it and pay an extra couple of hundred $ for renewal for 10 yrs.

I think the max allowed time to respond to RFE should not exceed 12 weeks and to a NOID 30 days.

I think you are the first one ever to actually hope for a RFE ;) but I get it why you want one.

I got one and I had to submit the missing evidence in 87 days. But you have to make sure that USCIS receives the documents within those 87 days - like stated above. My AOS process took exactly 4 months to be completed - that's including the RFE (and I took my sweet a.. time replying).

I guess I wish you good luck on receiving a RFE so you might be able to get the 10year-GC right away and not have to worry about lifting of conditions upon receiving the conditional one. If USCIS approves you only 1 day before your 2year anniversary you will still receive the 2year-GC. That happened to someone on VJ here, I read about it.
