How are you late in filling???? looking at your timeline you were approved sometime in April 2006, so your 2 year greencard will expire in april 2008, the earliest you can file is 90 days before the expiry date....

So you are not late in filing....

Is okay to be a week or two late filing for the I-751? Will we still get an extension letter?

It's ok. I filed petition almost 2 years after the 2-yr anniversary and just got approved.

Please remember to write a letter to ask for an excuse along with your petition.

06/17/2003 Conditional Residency Granted In New York City

06/17/2005 Conditional Residency Expired.

04/26/2007 File I-751 Joint Petition To VSC ( Almost 2Yrs After My Conditional GC Expired)

06/05/2007 Package was returned by VSC due to the mistakenly printed amount on the check.

06/06/2007 Resubmitted the new check with the package.

06/25/2007 Check Finally Cashed.

07/05/2007 InfoPass Appointment Scheduled For A I-551 Stamp on my passport.

07/16/2007 The Big Day To me, Got a temporary I-551 stamp valid until 07/15/2008 from new york city local office along with the copy of the cleared check, copy of filed joint petition, receipt of the InfoPass Appointment,

expired Green Card & valid Passport.

07/17/2007 Left New York For China with my family

07/17/2007 Received NOA of I-751 Dated on 07/05/2007

07/19/2007 Received BioMetrics Appointment Notice Dated on 07/16/2007,

finger prints scheduled on 08/01/2007

08/05/2007 Return Back To U.S.A at JFK International airport without any problem along with my expired GC,

Temporary I-551 Stamp with my passport, btw the immigration officer was very nice and professional.

08/07/2007 Biometrics Appointment Make-up. Staffs in Jackson Height Service Center are good. No further questions were asked even though I was late a couple of days for it. I waited about 20 minutes and entire procedure was only taken about 7-8 minutes.

The case is finally touched and I'm done for a while.

08/07/2007 Registered USCIS online case status notification via email program and wait for the good news from 'em soon.

On 01/09/2008, Updated Status: Card production ordered.

Thanks Kezzie. The expiration date is 4/10/08 so we should have mailed it yesterday 1/10/08. Hopefully we'll mail it Monday the 14th. I didn't know if we'll get in trouble with USCIS.

I was also asking for another couple who card expires 3/22/08. They haven't sent their application in yet. She thinks it's okay long as it's before the 90 days expiration date.

Your friend is 100% right..... you can file anywhere between the 90th day and the day of experation.... I would not leave it until the last day but anywhere in between is ok.... you have plenty of time to file....

Thanks. Do you think either couple will get an extension letter? Sorry about the questions but I keep hearing different things. I'm worried about my husband still working and able to travel.

NO, no, no......It's not late until after the expiration. You CAN file it beginning 90 days before the expiration date. It's in your best interest to do it early. But, it is not a MUST. Not late until after that expiration date.

You will get an NOA that will extend the visa for one year while they process. This letter can be used for employers, DMV's, travel, etc.

Once you file for removal of conditions you will get a NOA in the mail.... this is the extension letter and it extends your greencard for 12 months and allows for work and travel...

If you can file at the begining of the 90 days then you should have the extension letter before your 2 year greencard expires... but if you can file until closer to the end of the 90 days dont worry you will still get an extension letter once USCIS get your application...

Yes, well you were lucky! :) Please remember that acceptance, by USCIS, of an untimely filed I-751 is discretionary.

HEY !! well i just got our extension letter in the mail today, so the wait begins. My check was cashed by CSC and i hear they move pretty fast !

8/22/03 - Met in Jamaica while attending a friend's wedding

2/14/04 - Got engaged while in Jamaica

6/12/04- Mailed I-129F 6/24/04- NOA1

01/26/05 -206 days since NOA 1. Got letter saying that my case is currently undergoing the increased security checks

3/2/05 -I'M APPROVED !!! 239 DAYS !!!! I CANT BELIEVE IT !!

03/09/05 - Got NOA2 in mail

4/6/05 Package came in mail from Embassy

5/16/05 Paperwork dropped off at Embassy. Waiting on interview date

7/14/05- APPROVED!

9/10/05-Chris and CJ arrive in Chicago !

11/19/05-GETTING MARRIED!

12/02/05-sent EAD and AOS

2/15/06-Biometrics done

2/25/06-EAD arrived in mail

4/6/06-AOS approved in CSC WITHOUT INTERVIEW

5/06-Received Green Card

I-751

1/28/08-mailed application

2/6/08-check cashed at CSC

2/11/08-received 1yr extension letter

7/12/08-10 year green card received!

Don't worry too much coz the form says DURING YOUR 90 days before the expiration of greencard. My 90 days started last Dec 31 and yet I submitted mine last Jan 28 only, yesterday I received letter saying its extended for 1 year. So I don't think its a big deal for as long as by the time they will receive your I-751 is not later than your expiration date :wacko: I believe they will understand expecially the fees went up :whistle:
