I had an infopass appointment regarding my lost 129f and the officer submitted a request to the CSC director i believe. Anyway she told me she'll call me this afternoon or evening with his instructions.

So i'm sitting at my desk wondering if i've just been had or if she really will call. Is this likely?

Yeah its 5pm here and still no call. I guess its just another thing to add to my laundry list when I send my form to the ombudsman. But this is getting ###### ridiculous. They A. Lost my application. B. Lost their system requests to find my application. C. They've lied to me on numerous occasions. They've cut me off multiple times (and i wasn't being belligerent).

I'm getting seriously pissed here. Its been 4 months and i'm still trying to get a ###### case file in the system.

I can speak from experience. I had a officer from CSC telephone me because of confusion with our approvals. They will identify themselves as USCIS from what Service Center along with your case number. So, yes they will do this.

Hi my parents apparently got the letter from USCIS yesterday saying I should resubmit but apparently there are no instructions regarding receipt dating. Should i just include copies of my old mailing slip and confirmation and ask them in a confident manner to back date to my original file date?

I speak from experience. They have taken my number several times and have never called me.my thoughts to you is to be persistant, call them every day if you have to.Make sure you write down their employee # (they announce it when they answer).I know how you feel,it is so frustrating to hear a different story each time you call them. :girlwerewolf2xn:

May 7,2007-USCIS received I-129f
July 24,2007-NOA1 was received
April 21,2008-K-1 visa denied.
June 3,2008-waiver filed at US Consalate in Panama
The interview went well, they told him it will take another 6 months for them to adjudicate the waiver
March 3,2009-US Consulate claims they have no record of our December visit, nor Manuel's interview
March 27,2009-Manuel returned to the consulate for another interrogation(because they forgot about December's interview),and they were really rude !
April 3,2009-US Counsalate asks for more court documents that no longer exist !
June 1,2009-Manuel and I go back to the US consalate AGAIN to give them a letter from the court in Colon along with documents I already gave them last year.I was surprised to see they had two thick files for his case !

June 15,2010-They called Manuel in to take his fingerprints again, still no decision on his case!

Ugg.....and now I just got a call from that i/o yesterday saying i should wait 60 more days...i assume those instructions won't damage my resubmission......

Was your check cashed w/ your original submission, or have you spent the past 4 months waiting without anything? If your check was never cashed, I would cancel that check, write a new check and resubmit, going by the instructions you have in writing on the letter received at your parents house. Those instructions you have on paper and in writing.

They will not backdate this new submission, however......because if you have no NOA1 and case number it basically means as far as anyone knows you don't have a petition pending with them. Only once they log you in their database and issue you a case number do you have any point of reference.

Showing them a return receipt from the post office will mean nothing to USCIS...

Good luck,

-P

Yeah i assume they will do nothing. But having the mailing receipt etc. in with the application may help my case when I get congressmen/ombudsman involved this spring. I will go by the september date throughout and continue to argue that i am past 7 months without adjudication starting april. Hopefully I can get enough people involved to pressure them. I know my relatives are all going to get their congressmen involved when the time comes that will be at least 3. I'll make Infopasses once a week etc. etc. write letters often.

Maybe they'll get tired of me eventually and bump me forward where I should be...or at least shave off a month.
