I have a quandary in that my fiancee needs to get her soon to be ex husband off of the mortgage. Without selling up and us starting afresh when I get over there in hopefully 7 months if the K1 goes quickly, is there a way I can get a mortgage here to buy the house jointly with my partner in the US or solely by myself?

As a non-resident alien, it might be tricky to find a lender that is willing to take the risk. Foreclosure process is impacted if the borrower is not a resident. However, there are companies that will, but the interest might be higher than practical. After you've secured a green card, LPRs are treated as US citizens by most lenders.

There are UK providers who finance overseas mortgages.

Must be many sources of info available in the UK, try WH Smiths, last time I looked there were loads of magazines on buying abroad.

Simplest thing would be for her to re-mortgage.

I live in Orlando, and we have a large number of foreign nationals who own property in my area...most rent the property, but some use it as vacation homes...

5/13/08 - Visa in hand!!!

7/7/08 - POE

7/11/08 - legal wedding

7/20/08 - AOS/EAD/AP sent to Chicago Lockbox

11/18/08 - AOS approved!!!

11/25/08 - Received welcome letter...and Green Card!!!

12/21/08 - ceremonial wedding

10/9/10 - Sent I-751 and started the fresh hell that is ROC

10/14/10 - NOA1 for ROC

10/29/10 - received appointment for Biometrics

11/22/10 - Biometrics appointment

Currently: Living blissfully with my Essex lad...
