:help: ok, ppl...so i overstayed in us (3years) does anybody know what r my chances to get K1, i am without my sweetheart just two days now, n it is killin me, i need to know when i am gonna see him again!

n it seems that everybody is saying somethin diferent about this overstay soooo, anybody havin this experience?

most likely your initial petition will be approved by the USCIS and then your visa will be denied by the consulate... you will then be required to file for a waiver to overcome... many people have successfully filed for waivers

USCIS will approve the petition, but you will be denied and barred from reentry to the US for 10 years due your overstay. You will need to submit a waiver to overcome this bar based upon harships to both you and you fiance. You will need professional help with the waiver.

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

That's the answer.

You can be prepared for this by researcing the waivers in the waiver forum and having it prepared before you go to the interview.

3 years or 4?

You stated in your last post that you overstayed for 4 years.

How were you in the states before? Were you there illegally or on a visa waiver program.

You can file but you will most likely be denied. You can then file a waiver. I suggest consulting a lawyer for help with that.

You stated in your last post that you overstayed for 4 years.

How were you in the states before? Were you there illegally or on a visa waiver program.

You can file but you will most likely be denied. You can then file a waiver. I suggest consulting a lawyer for help with that.

well i stayed in us 4years, but first 6mts i was there on visitors visa, which i extended for another 6mts, so one year i was good, it is the 3 years i was not then..(:

..so the petition will be approved but here on embassy they will denied me, or i will be denied right away? everybody is sayin diferent... :wacko: n as a metter of fillin the form, should i put in G-325A that i lived n worked in us, even though it was illegaly?...

All you can do is apply and be honest. You will be denied though. Then you'll have to file a waiver. Again, the assistance of a good immigration lawyer would be a huge help to you.
