hi,

My interview was today... and i am pretty much devastated as I got 221(g) for no reason. My case is as follows and I need your guys help.... I am 10 years younger than my wife... and this case of marriage is pretty much very very unusual in India.... The Consular officer a Lady asked me how did you meeet.. which chat rooom.. why did your wife get divorced and what dod you guys chat about... actually we dated 2 years ..she got divorced..then saved some money and came down here and got married to me... and in that time I could also be over 21 which is the legal age to get married in India....

There are 12 things listed in the list of 221(g)...... Of which I had the 7 of them in my hand.. which she refused to see and told me to submit to the VFS...... the other 3 things I neeed help which my wife has to get

1. Notarised statemennt describing and detailing how you met the petitioner and why you decided to get married.

2. Notarised Explanation from the petitioner on when and why her first marriage ended.....

3. Detailed contact info of each of the prior spouses.....

MY QUESTION IS :-

1)does my wife have to hire a attorney or she can do by herself by going to the loacl county court or get it done by a banking instituation and other such people which have the right to do notary in USA for things in point 1 & 2.

2) For her her ex husband... she has no info of her whereabouts.. what shall we do for that.. shall my wife give a letter in signing that she has no whereabouts of her exhusband.

PLEASE help ASAP.....

Do you think I would be denied or would they take tooo long to issue me my visa.... My kids and wife are waiting for me really bad....

November 13, 2009 - Receipt of I-1751 Fee

November 20, 2009 - Arrested on Domestic Battery(Had argument with wife)

December 18, 2009 - Biometrics Completed at 9 am.

January 13, 2010 - Receive I-797E Notice for more evidence

February 16, 2010 - Mail reaches Californa Service Center( Next day of Preseidents Day)

February 19, 2010 - Card Production Ordered. Status now IR1

Hi Jigi,

I am sorry to hear....hang in there and talk to some immigration attroneys in Mumbai.

You can try your best by preparing following information:

(a) get affifavits from both your family members and some friends in India and here in USA, that you are still married.

(B) just be honest and say to consulate that your wife is not aware of her X's where abouts.

© Your wife can prepare an affidavit stating her reason for divorce and similar affidavit from her family members should help.

Like I said hang in there, try not to get upset and do your best. Everything should work out smooth.

I am so sorry for your 221g. I know what you are going thru. The only positive is that they can not send it back to the US, like they did for my K1. So they might harrass you and drag this out but ultimately they have to approve you,

Which I am worried and dont want to happpen as I have eloped and ran away from home to get marrried

Jigi.. so sorry for the delay.

As far as the notarizations.. she can get them done by anyone who is a legal notary.

Many Banks will do for free.

Having to declare where her exhusband was or contact information and was not able to do so should be expressed in a letter as such. I think if she can get any statements from friends or family and have it notarized stating the same I would attach it as well.

Maybe she can list his last known information possibly what was listed on divorce documentation.

Detail .. detail detail.. how the two of you met in PERSON.. discribe when she arrived what airport.. where you stayed.. where you visited.. Do you have any documents showing supporting evidence.. ie hotel bills.. .. at this point in time.. I would give them everything you have that showed you met in real..

Also discribe how you decided to marry when she was there.

This kind of thing makes me sooo grrrrrrr... sorry you have to go through it..

I think submitting the above 3 items as requested by the consulate may help but you said they also requested contact names from close relatives and you were apprehensive about giving them that information.

I would write a personal statement describing circumstances that led to marriage and if your family approved/didn't approve, sign it and then provide contact information of close relatives.

Jigi I am so sorry that is so awful how they treated you! :crying: They are thinking if it is a fraud case, people will not go to so much effort, so provide all they ask for, and more. Give every single thing they asked for, in detail. In case info is not available (like wife's former spouse info or info of your relatives), explain the truth in detail in notarized statements.

In India they like to hear the families approve, so I am worried about how you eloped. They might try to contact your relatives. However just because your family may not know or approve, it is no reason to deny a visa. Often biggest red flags are big age difference, with the wife being the USC and older. Also previous marriages and especially children from previous marriage. However many of us got approved so you can, too! (I am USC and 16 years older than my Indian husband.)

As JanaknJanet said, your wife can get her statements notarized at some banks for free, or $10 per page fee at other places, such as gas station grocery stores, postal annex shops, etc.

I wish i could give examples of cases approved like they do in courts for reference.. I would have been approved by now... what kills me is my kids and wifes hopes are devastated completly..... all papaer work is being prepared as you have just mentioned... we are mentioning everything... I even told the opfficer truth that my parents dont approve our marriage.. but we are 2 individuals and the constitution and religion gives us the right to marry any one of our choice....

I want to be with my kids.... they are my world.. thats all i neeed god

December 18, 2009 - Biometrics Completed at 9 am.

January 13, 2010 - Receive I-797E Notice for more evidence

February 16, 2010 - Mail reaches Californa Service Center( Next day of Preseidents Day)

February 19, 2010 - Card Production Ordered. Status now IR1
