New processing times - is the USCIS lying?

NSC Updates on I-751 processing - 07/06/07 Nebraska Service Center (NSC) will no longer fee receipt Form I-751 Nebraska Service Center (NSC) will no longer fee receipt Form I-751, Petition to Remove the Conditions of Residence effective July 2, 2007. I-751 forms received at NSC will be shipped un-receipted to the California Service Center (CSC). WAC receipt numbers will be issued by the CSC along with adjudicated petitions. Also TSC (Texas Service Center) will be sending I-751 to CSC.

Well, I use to be one of those people who I really didn't care or concern myself too much with the backlog at the NSC. I just figured, it would happen eventually, so why worry? This new piece of information really irritates me. What the heck is going on there? Are they even processing the remaining I-751 applications or is the plan to eventually transfer ALL of them over to the CSC? Are new applicants still being told to send their I-751 to Nebraska? This is ridiculous.

This is not new information. It's from last July, when they started automatically transferring all newly filed petitions at NSC to CSC.

Yes, I've always known that the I-751s sent after July were being transferred to CSC. That's not what I'm talking about. I want to know is what is happening to the I-751s that are still sitting at the NSC. The ones sent before July 2007. Are they no longer processing ANY I-751s? Is my application just going to sit there until someone decides to transfer the rest of them to the CSC? Are they slowing plowing through them? What?

Nothing posted either on the N-400 except NSC does not even list processing N-400 applications, but, and again from the very latest....

Never a good idea to complain to any US government agency, and that includes all 1,526 of them, only gets you into more trouble. While our congress started and funds them, not want congressperson can name all 1,526 agencies and are not even aware of the rules they are making. In many cases one finds out the hard way by following the rules of one agency is breaking the rules of another agency.

It's best to take your nice pill when dealing with agents, be humble and helpful, even give them sympathy for how hard they have to work.

Also not good to be an individual, EPA recently fined a huge corporation that was dumping tons of pollutants into the air a whole $5,000.00, while a small vehicle AC shop with two guys were fined $67,000.00 for doing what they called scam retrofits, not even harmful to the atmosphere. If we really want action, all 3 million of us should march in Washington, DC, if there is 3 million of us, find that hard to believe. There are only about 40 of us here, about 6 in another board. Maybe just our cases have been dropped by the wayside, not a bad percentage when you consider about 50 out of 3 million.

Oh, and "every single one of us" would be about... hmmm 35 letters? I don't think you'd make a difference that way. If you really want change, vote (or have your spouse vote..) for the right people and address the folks above the service center level. You won't achive anything by bogging down the SC itself. IMHO

I noticed there is an email you can write to if you have a complaint about the USCIS. So I emailed it asking about the 6 month back track, about NSC not processing I-751 , about people who filed just a few months ago getting approved when a lot of us have been waiting well over a year, and a few other things. I got a reply back almost instantly!

If you are inquiring about the status of documentation you have filed with USCIS, or have a complaint relating generally to the nature of the customer service you have been provided by USCIS, please use our National Customer Service phone number 1-800-375-5283 or visit our website at www.uscis.gov.

I wonder if there's an email address I can write to to complain about their complaint email address not working.

Anyway, I'm going for another infopass on tuesday, but don't really expect the officer there to have any idea what's going on. If I manage to get a 12-month stamp I'll consider it a successful trip.

There are essentially the people you can send your complaints to:

-Both of your US Senators

- The Chair and Ranking Member of the Immigration Subcommittee of each House of Congress

Senate - Chair - Ted Kennedy (MA), RM - John Cornyn (TX)

House - Chair - Zoe Lofgren (CA), RM - Steve King (IA)

- The Secretary of DHS, Michael Chertoff

- THe Director of USCIS, Emilio Gonzales

-Your Congressman

- The USCIS Ombudsman, Michael Dougherty

- The Inspector General of DHS, Richard Skinner

These are the people who actually have the outside influence to do something and the people who need to know what is going on. If we do not let them know what is going on, they can't do anything about it.

And what is the job and the influence of the Inspector General? (I don't believe that the Secretary or the Director would react to our complaints if they are not brought forward by the other contacts on the list.)

I did write a letter the day the July 05, 2006 date came out, even included key documents with a plea of concern to make whoever read that letter easy to read, with all the information in front of them. No reply as of yet, and perhaps a waste of a stamp. Calling the toll free number on case status only results in keying in your application number to hear the same thing on the web and if your application date doesn't exceed the processing date, don't bother us kind of thing. Infopass appointments can only be made two weeks in advance and no sense in making that long trip until the very last minute.

Glad I made that call to my senators office yesterday, least have some knowledge and they promised to make the inquiry for us.

Just put a big red X on my calendar, won't hold my breathe, and if nothing happens between then and now, will make that infopass appointment.

What else can one do? Those that pushed either got yelled at or who knows what happened to their application. The ball is in their court. Those that I know that sent in their I-751 early, had it returned, but is 90 days really enough?

The Citizenship and Immigration Services Ombudsman (CIS Ombudsman) provides recommendations for resolving individual and employer problems with the United States Citizenship and Immigration Services (USCIS). As mandated by the Homeland Security Act of 2002 § 452, CISOMB is an independent DHS office that reports directly to the DHS Deputy Secretary. The CIS Ombudsman:

Assists individuals and employers in resolving problems with USCIS;

Identifies areas in which individuals and employers have problems in dealing with USCIS; and

Proposes changes to mitigate identified problems.

DHS Inspector General

The Inspector General is responsible for conducting and supervising audits, investigations, and inspections relating to the programs and operations of the Department. The OIG is to examine, evaluate and, where necessary, critique these operations and activities, recommending ways for the Department to carry out its responsibilities in the most effective, efficient, and economical manner possible.

To get any of those people to individually act on your application is most likely not possible due to the games CIS is playing. But it may help to make them aware of the fact that there are a large number applications sitting in limbo while others with the same types of applications who filed later are getting service. That may help..

This tack (addressing the overall problem without focusing on your individual needs) would be the best right now. What we really want is what those in TSC got.. our files being moved to CSC to be adjudicated. A rational argument outling the circumstances behind out situation, outling the situation for those who have filed ater July 2007 and outlining what was done with those in the same situation going through TSC and then noting why this has not been done for those who are waiting at NSC.
