Merry Christmas to everybody!!!

I am new here... it's a very good forum.

I flew to USA on early December to visit my fiancé, when I tried to pass through immigration I was stopped and held for questioning.

The immigration officer verbally harrased me for six hours until he got me to say that I planned on getting married to fiancé [the immigration officer also called my fiancé, asked my email including password and found our emails]

As a fact we would not get married against the law as I have a daughter left in my country and we have desire to do it properly n legally.

It was so cruel the way he discovered it was like to face a criminal!

I don't speak much English so he got me to say what he wanted me to.

She finally withdrew the application to enter the country and returned to my country. My tourist visa was canceled!!! I will be allowed to enter USA after I got appropriate visa [means fiancée visa]

We have since planned to meet in other country and will apply K1 as soon as we meet.

I am AFRAID that this past incident will hurt the petition.

CAN ANYONE GIVE ME ADVICE???? PLEASE HELP ME.... :help: :help: :crying:

Carefully read your passport and share what did they stamp in there?

There's stamp on visa plus reason number... I am told by immigration officer that I was not stopped to enter to USA as long as will only use K1.

Is that true what officer said?

They will question me later when I get interview? It will affect me to get success? Honestly, I am afraid... :crying:

Tourist visas can be canceled or entry denied for reasons that don't apply to a K-1. Particularly intent to immigrate. If that is the case, then having a tourist visa withdrawn will not affect your K-1 petition, other than you will have to mention it on a couple of forms.

As far as your treatment at the PoE, there is not much you can do about it, you are not a citizen or LPR.

My fiancee went through a similar situation in Vancouver. The guy basically told her she couldn't enter for 5 years without the k1 in hand. It was total BS and has really given me a very cynical view of our immigration service.

All you need is a modest house in a modest neighborhood

In a modest town where honest people dwell

--July 22---------Sent I-129F packet

--July 27---------Petition received

--August 28------NOA1 issued

--August 31------Arrived in Terrace after lots of flight delays to spend Lindsay's birthday with her

--October 10-----Completed address change online

--January 25-----NOA2 received via USCIS Case Status Online

I think he/she stamped "241" in your passport meaning you were refused entry only. Corresponding to 8 CFR 241. They are just saying that your ties to the US are a little too strong to use a tourist visa for entry, but haven't stamped any actual violation in your passport. This should not effect your case at all. Make sure that your fiance and you report this and discuss it openly and honestly with your interviewing officer at the Jakarta embassy. and with POE officers, they have whats known as "expedited removal powers" which they are given to turn away/deny someone and send them on their way at the port-of-entry where you enter.

Because ultimately, they are the ones who decide to let you in or not, and remember, especially with a visa, and even worse off, a B1/B2 tourist visa, AND being from a third world country such as Indonesia

A visa basically gives you permission to approach the POE and "ask for permission" to enter the U.S. a visa doesn't mean that you've been granted the right to enter, only to ask, which in turn the POE officer then decides.

Oct 29th -First phone call
Dec 25th -She purposed and i said Yes!
May 10th I-130 Packet and Packet 3 sent off to me by the U.S. Consulate
May 16th -Received Packets 1-3 from the U.S. consulate
June 29th -I arrived in Puerto-Rico!
July 2nd -Married in Mayaguez, Puerto-Rico and also got our interview date for September 6th
August 17th -We arrived in Australia to file for Sep. 6th
September 6th - Filed DCF in Sydney and approved 1 hour later!
September 12 -Received my passport with the visa and yellow packet
November 24th -POE.......Guam,USA
December 12, 2005-Green Card arrived in the mail
September 11, 2007 -Filed I-751 on conditions
September 17 -VSC Receives my I-751 and issues NOA1
Oct 10 -Had biometrics taken in San Juan, Puerto Rico ASC
Oct 12 -Touched.
Aug 21, 2008 -Approved!...........finally
Sep 17, 2008 -Mailed off N-400
Oct 22, 2008 -Biometrics taken in San Juan ASC
Feb 12, 2009 -N-400 Interview
Feb 26, 2009 -Oath.....the end.

3rd world country? Australia is barely above that status. Indonesia has a longer and richer history than that pile of sand (really another british colony) except they won their independence the hard way just like we did (US). <yawns> with boredom at your patronizing tone.

To the original post: Don't worry. Nita and I tried to get a tourist visa after we were married and were flat denied, it's common practice to do that at the various posts due to strong ties to the US. Accept an apology for the way you were treated, the USCIS looks under every rock for imagined terrorists and love hassling people with brown skin. Good luck on your journey
