2 Quick I-864 Questions

Hello Every body!

 

Would you be kind to help me please with these two straight forward questions please?

 

1)- If I understand well, my Petitioning USC Wife has to fill the form through DCF London, even though she has neither income nor asset and will be using a joint sponsor, so:

The form asks the sponsor their mailing and their physical addresses. My wife has now moved to the United States ahead of me to prepare the house and other needed things, so she is now residing there, but we're doing a DCF, so I guess it would be assumed that she still is residing with me here in the UK, but she no longer is.

Should I put mailing address in the US and physical address in the UK, or both in the US please?

 

2)- Am I supposed to have an Alien Registration Number (A-Number) or a USCIS ELIS Account Number yet or I have these AFTER I have moved to the US?

Timeline

As long as she was residing in the UK when you did the petition to USCIS London, it's okay for the visa part (DS-260, interview) that she has moved ahead of you. She can put her US address. It's actually a good thing because her US address takes care of the domicile issue many DCF people have to address with the I-864.

 

These are two separate parts of the government.

Dept of State (consulate)-- Visa application, interview

We will put USA on both addresses then!

1 final Question if you will please and if you know, @Wuozopo:

 

The form asks for our assets.

We've bought our house outright as Fanny May, a Foreclosure at $14k, but it is now valued as $32k.

I also have a loan for $31k in the UK.

 

Are my assets

$32k - $31k = $1k

Or

$14k - $31k = -$17k

And

Can my assets be in the negative?

You get an A number when the petition is approved. I'm not sure how a DCF person gets theirs. On a regular petition in the US, it is printed on the petition approval notice before the case gets sent to the embassy. So yes, you would have an A number before interview.

 

The ELIS number will not be available to you until after the visa is issued. There is a fee to be paid to USCIS  after Visa that covers the cost of issuing the greencard once you arrive in the US. Some pay before entering US  and others wait and pay later. Whenever you pay online, you set up an account and generate an account number.

Is the loan associated with the house? I got lost. If your house is worth $32k and there is no mortgage on it then your asset is $32k. If you still owe $10k on a house loan, then your asset is $22k.

 

Debts are generally not counted...a student loan for example or big balance on a credit card. The only way I can think of a negative asset for this form is if you still owed 30k on a mortgage and the house wasn't worth as much as you still owed. In that case I would leave the asset section blank. It is optional and is used for boosting your case. Or I would leave the house off the asset list.

All I have so far is a file number without a number, just... the letter A, as on the attached picture.

I guess I may get it once I get a case number? We'll have to see.

 

Thank you so much for the insight too! The loan I made was not attached to the house, it's unsecured. So it's good news I guess 😁.

The property we own in the US is in both my wife's name (primary sponsor) and mine (applicant)

 

In the i-864 it asks in part 7 *optionally* the principal immigrant's real estate holdings.

 

For my joint sponsor, i asked he put my estate asset as above in this thread...32k, but for my wife..... shoukd she put that for BOTH me and then for her too? Surely it will duplicate the amount....

 

What would you recommend please?

The two sponsorships are viewed separately. Somebody has to qualify for the whole thing. If the asset allows your wife to sponsor, then you don't need the joint. 

 

If your wife and you together don't have enough, then she doesn't even have to list the asset because she doesn't qualify anyway. They look to the joint sponsor to fully qualify. Does he need your asset to put him over the threshold? If not, then I wouldn't bother. Are you reporting only your half of the asset? Gets complicated if not needed anyway.
