My husband just got naturalized as a US Citizen through US army Mavni reserve.Currently he is on his AIT training. I am a F-1 student working under my OPT as a registered nurse.My OPT expires 01/14/2017. we are planning to apply for my green card. What documents can we include to show proof ofincome? Since we were students we did not have enough income on last year tax returns (barely anything). Will my husbands income as a army reserbe be enough to sponsor me? Can I use my income as well?if so what would be the appropriate documents? Also we got married on december 12,2015..so when we filed taxes this year on jan 2016,we filed separately as single as that was what our w-2 said.Will there be any problem because of that? Any help is greatly appreciated. Thanks

First you guys were wrong to file taxes as single since you guys were married as of December 31st the previous year. You guys should have to amend your taxes with the IRS to fix that. You shouldn't have gone with W2's but with the status of your relationship.

Your husband will still fill out the affidavit of support to show he can support you. The good news is even if he doesn't meet the income requirement, you can also supplement your income as well since you're currently working legally and earning an income. Just make sure you do all these before your OPT expires next year voiding your work authorization status. You'll have to send in copies of pay stubs preferably last 6 months, letter of employment and copy of your EAD to show work authorization. Follow I-864 form instructions you should be fine.

8/18/2014: Accepted in Chicago. Transferred to Nebraska Service Center.

8/21/2014: Received NOA 1. I-130, I-485, I-765 in mail.

8/25/2014: Received biometrics in mail. Scheduled for 9/8/2014

9/24/2014: EAD approved. 36 Days!

10/01/2014: EAD mailed.

10/03/2014: Received EAD card.

10/14/2014: I-485 moved to testing and interview.

1/28/2015: Interview scheduled for 3/4/2015.

1/31/2015: Received interview notice.

3/4/2015: Interview completed and APPROVED!

3/5/2015: Welcome notice mailed and I-130 Approved.

3/10/2015: Welcome notice and I-130 approval notice received.

I wish we had asked a professional on that matter before we filed for the taxes, but we thought since we were single for 2015 and students with barely any income it would not matter. :( Please help. Go ahead and file your paperwork. Your petitioner should bring the amended tax transcript or return on the day of you guy's marriage interview.
