How Many Ports could a Passport Pass If...

Timeline

Dyn (Filipina fiance) has her CENOMAR (post annulment) in hand. Next step is to get a new passport to match her newly acquired maiden name (current passport has married name). My question is not whether Dyn should get a new passport, but rather, if she gets a new passport and reverts from her married name to her maiden name, will her passport number change?

Why is this important? We recently submitted the I-129F package and Dyn's Philippines passport number was required (the one with her married name). Additionally, Dyn's Letter of Intent to Marry, and her statements of How We Met and Our Two Year Meeting were all signed with her maiden name only, and not her married name. For consistency's sake, her Postal ID and her passport should match, yes?

The passport number changes any time you renew the passport, regardless of name changes or anything else.

Any way, the number is only needed for the ds160 application at the very end of the process.

If it isn't difficult, it isn't worth it.

Yes you should get the new passport, and yes the passport number will change. An annulment is as if the marriage never happened, it is not like a divorce where the person can keep the married name.

Dyn's new passport and her postal id don't need to match. FYI, when she changes her passport, they'll give back her old passport. If she ever runs into any issues, she can simply show her old passport.

Now for my question: Where on the I-129F does it ask for your fiancee's passport number? The I-129F does not ask for the passport number, UNLESS she is currently living in the USA.

Oops! That's not good,and you are right. I filled out line 15e in Section 2 of the I-129F with the beneficiary's passport number. I didn't even notice it said "if she is currently living in the United States". Thankfully, that is the only line I completed other than the passport expiration date and country of issuance. I hope that doesn't induce an RFE. Yikes!

I didn't read thoroughly, and based on your response I realize that section was reserved for a beneficiary who is already in the U.S. In your opinion, will this little slip up result in an RFE, or worse?

She needs to apply for a Passport renewal (Not a New passport application) with a name change. The form should be on her Maiden name. She can do this even if the passport is still valid for years. Bring an Annotated MC from PSA, BC from PSA and copy of complete Annulment papers, bring the original just in case they ask to see it, but a copy of annulment will suffice for the application process. I was not asked for a Cenomar/ Cemar when I renewed my passport and revert back to my maiden name, but since she has it already she can also bring it and present only if asked. DFA will get all original of PSA docs.

I seriously doubt your I-129F booboo will be an issue at the USCIS or at the embassy level. If you get an RFE from the USCIS, it will only set you back a couple of weeks. By now, you're probably getting used to delays anyway...lol...!

Just in case, I would send Dyn a corrected I-129F for her interview. Make sure you send the original.

I wouldn't bother with a corrected I-129F for the interview.

I do suggest sending a copy of YOUR G-325A so your fiance has details about your as that info quite often is asked at the interview.

Imagine how disappointed Dyn would feel if she received a 221g for not having a corrected I-129F. Having it is cheap insurance. Always better safe than sorry.

Timeline

She needs to apply for a Passport renewal (Not a New passport application) with a name change. The form should be on her Maiden name. She can do this even if the passport is still valid for years. Bring an Annotated MC from PSA, BC from PSA and copy of complete Annulment papers, bring the original just in case they ask to see it, but a copy of annulment will suffice for the application process. I was not asked for a Cenomar/ Cemar when I renewed my passport and revert back to my maiden name, but since she has it already she can also bring it and present only if asked. DFA will get all original of PSA docs.

Dyn (Beneficiary in Philippines) traveled from Bohol to Cebu on Monday. She visited the DFA with the following annulment documents in hand:

  • Judge's decision
  • Entry of Judgement
  • Certificate of Finality
  • Annotated MC from PSA
  • Annotated MC from LCR
  • BC from PSA
  • Original MC from PSA
  • CENOMAR

Even with all documents in hand she was denied renewing / changing the name on her passport. Thankfully, she also had a signed affidavit from an attorney stating that she was who she claimed to be and that her married name and her maiden name belong to the same person. Only with that affidavit was she able to start the process. Additionally, she must return to the DFA five days later at a scheduled time for stage 2 (fingerprints and an appearance before a DFA official). Strangely, she was already fingerprinted during the first stage on Monday. Only in the Philippines.

Yes, that is odd considering they require appearance again with an existing passport. I renewed and change my name at DFA Asiana. I was expecting a regional office will be more lenient apparently they are not. Good thinking on the Affidavit of oneness!
