Well its been 1.5 months now and haven't got any any letter from DOS. And its been 2 weeks but no reply of email which I sent them.

From USCIS, I have only got receipt number in May. Since then nothing.

OK.

You should have received a letter from DOS 2-4 weeks after they made the decision (how fast you get it depends on USPS and how far you live from where they send the letters).

If you got the NOA 1 in May, it has been over 5 months. Roughly, people get the final decision from USCIS in 2 months or less (there are exceptions of 6 months, but those are very rare).

I send another email to the waiver division. If they do not reply in a week, send them another email. You need to be very brief and specific about what you want them to tell you.

You should call USCIS and make an inquiry about your case because it has been too long.

Dear all,

This process is finally over for me. These are my timelines:

1) Advisory Opinion:

Department of State Advisory Opinion Finding: Subject

Item Action Date
212(e) Finding Letter Sent September, 30 2016
Form DS-2019 Received August, 25 2016
Advisory Opinion Request Received August, 25 2016

2) No Objection

Department of State Decision: Favorable Recommendation

Item Action Date
Recommendation Sent August, 28 2017
Response to Funding Source Memo Received August, 23 2017
Funding Source Memo Sent January, 10 2017
No Objection Statement Received December, 08 2016
Fee Received November, 30 2016
Form DS-3035 Received November, 30 2016
Form DS-2019 Received November, 30 2016
Passport Data Page Received November, 30 2016
Statement Of Reason Received November, 30 2016
Other Received November, 30 2016
DOS Case File Number Sent November, 30 2016

3) At USCIS, the case was received on 06 Sept 2017, and approved on 14 Sept 2017. I received the I-797C and I-797 by mail not in the US address I had indicated when I submitted the original package, but instead (and surprisingly) in my home address abroad.

4) I applied for the Visa in the US embassy in my home country and in less than a week had the visa approved and was finally able to fly to the US (from where I am now writing) and be onboarded in my new job on 31 October 2017.

Hope everyone manages to have their cases sorted out. Good luck, and happy Thanksgiving!

Thank you so much for your reply.

I will send them an email again for sure. I did call USCIS a week ago and they said they are processing as of May 16 and they received my 612 on May 18 so I should wait.

Let's hope DOS gives me a reply.

Was yours a no objection waiver? If so, it is odd since I got my waiver in August and it took less than 2 weeks from DOS send their opinion to USCIS to receiving the official waiver from USCIS in the mail.

Hi all, the shared timelines were really useful for me during the wait at DOS so I wanted to share mine:

image.png.674bca23e815373cf43a845e3140b8f6.png

Which in the end wasn´t a bad wait (I asked some higher-placed person at the university that is hiring me to place a call on November 6 to see if this would expedite things, to this date I still don´t know whether he managed to or that it was just coincidence).

I received the I-797C form a few days ago with my receipt number, the online status says "On November 16, 2017, we accepted your Form I-612, Application to Waive Foreign Residence Requirements"

I presume this means it is being processed, not accepted right? Does anyone have any idea how long this process may take?

Correct, it means it is being processed. For me, it took almost 4 months to get the approval but let's hope your lucky streak continues and it's approved in a few weeks.

Happy New Year everyone!

I never thought that I would have to apply a wavier to change my F-1 to H-4. I was on J1 as an au pair in 2012 for a year. Last year, I got married in New York. I went back to China thinking changing my visa was so easy! But they say you have to get a wavier from uscis. Then it begins:

Sept.11 Applying NOL

Dec.8 Got the NOL from Chinese government

Dec.28 Dos sent FR

Jan.8 Recieved an I-797C copy from USCIS

“Case was received at another USCIS office”

what does that mean? Can I expedite my case even tho it’s obly been 10 days? I have been separate with my husband since August!

Who should I call? Thanks for all your help!
