Hi,

I recently got married to my husband who is a US citizen.

I have a 7yr old daughter with me here in the US who carries the family name of her biological father.

I would like to ask how can we change her last name?

Must it be done in the US or Philippines.

Calling all those who had gone through the same experience as mine.

Are you talking about your daughter having your husband's name? That is called adoption. And the process varies for each state.

It won't be that easy to change the child's name. A legal and formal adoption is needed.

I'm interested to know about this as well. My fiancée will take my name but her son has his father's last name. I plan to adopt him and change his last name to mine.

The first step in officially changing your name is to file a name change petition in the proper court and pay the filing fee.

In most states, the person making the request must publish a notice in a local newspaper stating that he or she has filed a name change petition. If other individuals (such as the parents of a minor child or a spouse) would be affected by the name change, then notice must be given to the affected party.

Usually, the court will order a hearing for final consideration of the name change petition. This is also an opportunity for interested parties to comment on the name change. If the court does not find any reasonable objections, it will issue a judgment authorizing the name change.

You can change your name by filing your documents ($139 on legalzoom.com) with your county clerk of court. Pay the court costs. There will be a court hearing as to why you want to change your name etc. and then a final judgment.
