Manila co-sponsor question

Hi Everyone,

I am really nervous about the financial part of the upcoming interview and I want to share with all of you my situation.

I have lived in the Philippines for almost 2 years and haven't had a job on record for 3 years or so. I lived at home with my parents before I came to PH and have their address listed as my own on the I-130 and my G325A. I was doing some off the record Filipino wage based IT consultations remotely while in PH for part of the time. My mother was sending me money through Xoom (I have all M. Lhuillier remittance receipts to show at the interview). I also had money on my US bank account when I arrived here (about $3500USD), plus my mother deposited cash to my account though out my living here. (I have all my bank's original monthly statements to show at the interview, I withdrew this money at ATM's here) My case is a IR-1/CR-1 Visa for my wife and we are using my father as a co-sponsor whom makes 75k a year. I have never been to college but my wife graduated and as a registered nurse here in the Philippines. What are the odds guys? Thank you all in advanced.

What are the odds guys?

Hmmm...no job...no current sustained income...no paycheck stubs...no W-2...no income tax return...no liquid assets...no proof of domicile in the U.S...and an Embassy which frowns on joint sponsors.

Don't worry about the previous response. Manila frowns on joint sponsors for K1. You are CR1 and are allowed by statute to use a joint sponsor. The consulate does not have discretion whether or not to accept the joint sponsor for the CR1.

Don't worry about the previous response. Manila frowns on joint sponsors for K1. You are CR1 and are allowed by statute to use a joint sponsor. The consulate does not have discretion whether or not to accept the joint sponsor for the CR1.

The embassy must to accept the joint sponsor for CR-1, but not for K-1. So you should be fine with that. Since NVC accepted it the embassy will as well.

I don't own in the states since I rented most of my adult life. I have no job because I moved to the Philippines with no plan to return home anytime soon. It wasn't till about October that I got an outsourced job for which I have only Paypal transactions and salary email stubs to show for. And that is also PH wage based. I don't have a car because I sold it before I came here.

The embassy must to accept the joint sponsor for CR-1, but not for K-1. So you should be fine with that. Since NVC accepted it the embassy will as well.

From the Department of State website:

Does the NVC review Affidavit of Support forms for petitions filed at a post (embassy or consulate) abroad?

No, the NVC reviews only Affidavit of Support forms for petitions filed in the United States with United States Citizenship and Immigration Services (USCIS).

If the consular officer says the applicant needs a joint sponsor, does the joint sponsor send the I-864 to the NVC for review?

No. If the post asks for a joint sponsor, the joint sponsor must send the completed I-864 directly to the applicant. The applicant will submit the I-864 to the consular officer for review.

OUR domicile would be the home of my parents, since all my checking accounts and IDs have my parents home on it.

OP: By law, when an immigrant visa is being sought (such as a CR-1), a joint sponsor is allowed (john_and_marlene correctly stated this).

How does he not have US Domicile? His family is still there. He has a home. He has bank accounts. Could one have any more proof of domicile? Besides, that's no even something that will be asked. They MAY ask, but likely wont.

A tax return is not required.

Assets are not required.

You should read up a few basic things. I think this site has some easy-to-read, condensed information. Try the Guides section.

Probably 99% chance. Don't worry.
